AINP Letter- Employer drive- can apply for open work permit?

Hi All,
Anybody face the same problem before?
AINP letter came after my work permit expired,
As I called CIC My work permit will be refused because no AINP and LMIA in the package.
So I’m going to use my AINP letter to restore my work permit later and preparing it now.
I was trying to submit the application on line, there are several question I’m not sure:

1. CIC online question: What is your current immigration status in Canada?
Should I say worker or visitor ( I’m going to change the status from worker to visitor once get the refuse letter)

2. CIC online question: Does one of the following apply to you?
I applied for permanent residence to an office in-Canada and was determined to be eligible for permanent resident status (first stage approval).
Should I say yes for above? I got the XEP file number from CIC on May 1st.

No matter what I choose, it always pop up I’m allowed to apply for open work permit.
As there are many people’s open work permit was rejected as I seen on this forum, I want to apply for close work permit since my AINP is employer driven.
And I want to submit the online application instead of paper because it is much faster.

My work permit is in processing, I applied it before last WP expired. but it will be rejected because missing documents.
I sent the application package on Feb 5th and Nominate letter on March 11th.
When I called CIC and want to make sure they put my AINP letter into my application before officer start to review my case, they denied.
and my work permit will be rejected next week according to the CIC processing time schedule. they are working on Feb 1st case and I submitted on 5th.

So I have to restore my work permit by nominate letter.

Just called CIC for below question:

1. CIC online question: What is your current immigration status in Canada?

Agency said if my working permit is rejected, I will be not visitor nor worker, then there will be no option for me to choose, means I can not able to continue to apply on line, but Agency said it is ok to apply online but can not tell me the solution.

Anybody have experience about it?

I have been in the same situation in 2012 wherein I had sent my WP application without an approved LMO. Before CIC started processing my WP application my LMO was approved and I had called CIC and updated them with the information. Inspite of the approved LMO in place CIC had refused my WP application but I was successfully able to represent against the refusal although I lost about 2 months before I received my WP.

Here is what I suggest you do:

Call CIC again and update them that you mailed a copy of your PNP nomination on March 11th, 2105 and that a note be made on your file to add this information to your WP application. Remember to ask the name of the agent you speak with along with their employee code (CIC agents are obliged to give you this information). This information would be useful when you would need to make a case for review of your application with CIC.

In case your WP application is refused send CIC a letter detailing your interactions with CIC agents (on the safer side call CIC at least 2 times and speak with 2 different agents) and that your WP application should be approved. Be firm and polite in the letter you send to CIC. I will PM you the address where you need to send this letter.

You will have 90 days to apply for restoration once you receive the WP refusal letter from CIC. I hope someone in this forum who has applied for restoration in the past would be able to offer you advise on this.

How did you get Job offer? I'm trying from past one and half year from India. but not succeeded.my working background is Finance & Accounts.
