Hi, anyone knows about the current rule requirements? I understand that the sponsorship of dependent child needs to be made before the child is 19, and the current government is proposing to reinstate this to 22, though this is not effective yet. Can I enquire if the sponsorship can be made later than the age of 19 if the child is undergoing full time education prior to 19 and that he or she is fully supported by the parents financially? If the latter an effective rule currently? If yes, is there an age limit for the child after the age of 19? Is it 22 i.e. the sponsorship can be made later than the child is 19, provided that he or she is undergoing full time education and is supported by the parents prior to 19, and that the application is made before he or she is 22?
 
There is no current rule allowing for education exemption to age, that condition was removed when the age was reduced.

Perhaps when the liberals increase age back up to 21 and under they will also put back the education clause, but will need to wait and see.
 
Many thanks for clarifying the current age limit rule. In that case, I do need to raise my dependent child sponsorship application before March, as my child will turn 19 by then. This is a deadline in my case then. I shall be raising the application for my spouse and child in one application. Presumably that will not change the age limit. And my application needs to reach the immigration office before my child turns 19 right? During day time, I noted that the immigration office shall accept courier? I am running out of time. Thanks.

Yes - the application needs to reach CIC before the child turns 19. I would send the application now if at all possible Sometimes applications are returned due to missing forms, signatures or other errors. If you wait and send in the application just before the dependent turns 19 and then the application is returned to you - it will be too late to include the child.

Yes as long as CIC receives the app for your spouse and child before the child turns 19, their age will be locked in for duration of application processing.

Make super sure you do all forms correctly and sign everything where needed. If there are any mistakes in your app and CIC returns your entire package back to you, your child may not meet the age of dependent when you correct and re-submit your application.

Of course with age limit being raised sometime in near future, you would have a backup plan just in case.
 
Many thanks. The guidance is very useful and I now know about the urgency of the submission. I live outside of Canada now and would try to courier the application during day time. The best I can do is to do the courier one week from now. If the application is returned, I think I would miss it as the age limit deadline is the beginning of March. Anyhow, I think the return, which I would try my best to avoid, would be very close to end of Feb if it really happens, even though I try to courier the application one or two days earlier. I am just beginning to fill in the forms. Thanks again.
 
Actually when I was commencing to do the research and fill in the forms, I discovered the below guidance in the canadavisa.com:

Requirements for the Sponsored Person:

The sponsored person must be in one of the following situations of dependency:
Less than 19 years of age and not a spouse or common-law partner; or
Has been an ongoing full-time student since before the age of 19 and has depended substantially on the financial support of the parent since that time; or
Is 19 years of age or older and meets the following:
Became a spouse or partner before the age of 19;
Has been an ongoing full-time student since before the age of 19; and
Has depended substantially on the financial support of the parent since they became a spouse or partner; or
Is 19 years of age or older and has depended substantially on the financial support of the parent since before the age of 19 and is unable to be financially self-supporting due to a physical or mental condition.
Requirements for nature of the relationship:

The Sponsored Person must be either:
The biological child of the parent if the child has not been adopted by a person other than the spouse or common law partner; or
The adopted child of the parent.
Note: The government of Canada has outlined a plan to increase the maximum age of dependent children that may be sponsored to less than 22 years of age. This page will be updated when further news is announced.

So after reading the above, I thought that the beyond 19 age education exemption is currently valid, and I need not be in a hurry.

Do you know if the website contains not up-to-date information or I misunderstand the current rule above?

Are you a Canadian citizen or PR?

If you're a PR, of course you must be inside Canada to qualify as sponsor and submit a PR app. If you're a PR and submit while you're physically outside Canada, you can expect the app to be rejected and returned.

Understood and thanks. I by now have checked the definition of dependent child at the CIC site and found that the beyond 19 age education exemption (except for physical or mental reason) is not included. So the canadavisa.com site might simply contain out-dated information, I guess.

I am a Canadian citizen and can do the sponsorship.

Separately, my brother who is also a Canadian citizen who is now living outside of Canada. He has a biological child who was born outside of Canada AFTER he became a Canadian citizen. This is unlike my case whereupon my child was born when I was a Canadian PR BEFORE becoming a citizen. For me, I need to apply for the sponsorship. Can I enquire whether my brother's child (who is now around 13) can simply apply for a proof of Canadian citizenship without going through the process of family class sponsorship? Many thanks.

Yes, your brother's child can apply for Canadian citizenship certificate (proof of Canadian citizenship).
