Advice on maintaining RO

I got my PR Card renewed after wait of over one year. My renewal was stuck in secondary review and then they asked me to apply for PRTD as i was outside Canada, they issued me PRTD in two days and sent me the letter that my PR has been approved but then i was waiting finally they asked me to collect PR Card from CIC office which i did on Monday.

Now i want help from this forum about maintaining my residency obligation. Here are the facts.

1- I have been outside Canada for 2-1/2 years and have just returned to collect PR Card.
2- I have a business back in my country of birth and have to complete a project which might take one year or may be a bit longer.
3- While i was away i got married and have a little daughter, both my wife and kid are not Canadian PR

I have following questions in mind

1- I have been told my one immigration consultant that since this is my second PR Card i have to complete citizenship requirement as CIC do not renew PR card for more than one time. What he told me was even if i spend 730 days in Canada i will not get new PR Card after expiry of this card, is it true ?

2- For Citizenship there is a law to stay in Canada for at least 183 days in a year, which i am afraid wont be possible for atleast one year.

3- I have to go back so how long i can stay outside Canada now after i got my renewed PR Card ?

4- Is it possible to sponsor my family while i am not in canada ?

Will appreciate if some one can suggest the way to maintain my RO in the circumstances mentioned above.

You must have permanent resident (PR) status in Canada, have no unfulfilled conditions related to that status, and your PR status must not be in question. This means you must not:

be under review for immigration or fraud reasons, or
be under a removal order (an order from Canadian officials to leave Canada), or
have certain unfulfilled conditions related to your PR status.
You do not need to have a PR card to apply for citizenship. If you have a PR card, but it is expired, you can still apply for citizenship.

so instead of applying after 5 years for citizenship apply after 6 years


3- I have to go back so how long i can stay outside Canada now after i got my renewed PR Card ?

As your first question if pr can not be renewed then better to come back to canada soon after finishing your project

4- Is it possible to sponsor my family while i am not in canada ?

no you can not sponsor from outside canada.you have to be in canada and provide necessary financial documents required .Depending on your home country it may take longer time for your family to come to canada

1) Get a new consultant. He has no idea what he's talking about. PR cards are renewable for as long as you're in compliance with the residency obligation requirements.

2) The current citizenship eligibility requirements are well documented. However, the 183 days is only one component.

3) At any point in time, you must have 730 days out of the preceding 1825 days in Canada. You would have to do your own mathematics for your specific circumstances. It doesn't start the 5 years clock from zero when you renew.

4) No. That is a privilege given only to Canadian citizens when sponsoring a spouse. PRs are not eligible.

Your consultant is an imbecile. If nothing else - fire your consultant. If you have paid your consultant any money and your consultant is located in Canada, tell your consultant you'll report them to CIC for blinding incompetence if they don't refund all of your money immediately.

1. First step is to get rid of the incompetent consultant.

2. Go to CIC website and check the new requirements for citizenship. It will detail what's needed and give you a residence calculator that will tell you when you could potentially apply for citizenship.

3. Carefully review your Residence Obligation and don't fall into the 'I have a Valid PR Card' trap. Do a search on this forum. There is detailed info as to this RO concept. PRs that play roulette with the RO take the risk of PR loss. That you want to continue leaving outside Canada makes your situation worse. Type 'Canadian business' in the search engine on this section of the forum - you will find multiple posts on there on what is considered an exemption on the RO when you work abroad.

4. As a PR you have to meet the RO to sponsor and also meet the RO plus reside in Canada throughout the sponsorship application period. Read the thread below it will answer most if not all of your questions as the poster has similar profile to you including a non PR child requiring sponsorship...he got lucky...you may not!!
