Hello

My fiance was recently granted permission by the courts in the UK to move over to Canada with her child.

She is a citizen and i beleive the child is either a citzen or PR she is 4yrs old and both mother and daughter were born in UK but the grandmother has been a PR in canada for many years.

In the courts there was no mention that my fiance would need a photocopy and signed from the father regarding them moving to Canada but she has just noticed that on the CIC website its states that this is needed for her to gain entry and live in Canada.

Is this true? Was mentioned in court or placed in the order set by the court when she was accepted permission to go.

We are very confused as to what to do they were never marrried just a couple and he is on the birth certifacte.

When travelling with a child, the other parents permission is usually required. However, if she has a court order granting her sole custody and the right to move with the child, that should do the same.

If the mother was a citizen when the child was born, the child is too so in effect, she has nothing to do with CIC. She is a citizen travelling with her child, that's it.

If she were applying for the child's PR, she would have to prove to CIC that she either has sole custody or that the father allows her to apply for PR.
