Dear all

Greetings !
I need a simple advice if you can
I and my wife are getting through tough time now and we might get divorced and if this happens, she and my 2 year old kid might not go to Canada.

My questions are ;
1-If we get divorced, does that affect their PRs statuses ?

2-If I live in Canada and get the citizenship and my kid never goes to Canada and did not even renew his PR because he does not meet the criteria, Might he get the citizenship because I will get it ?
We landed and now in our home countries to finalize some stuff

Appreciate your kind advice !
Best regards,

Best regards,
1- Since you already landed the divorce won't change anything on your or their PR statuses.

2- Minors don't need to meet the presence requirement for citizenship. You will be able to apply for you kid citizenship in the same time as you request yours.

Thanks for your reply
To what extent are you sure about the second answer because another one sent me no they are affected and you cant apply for the kid

I corrected my other assumption in that as previous poster said there is no residency requirement for a minor under 18 however not sure how that works if a minor lands for a few days and then never ever resides in Canada whether that works or if in meantime PR status gets revoked at some point for not meeting residence obligation for PR as opposed to citizenship. It would seems strange even for a minor to be able to claim citizenship if they never live in Canada at all other than a few days landing maybe others can comment. http://www.cic.gc.ca/english/citizenship/become-eligibility.asp

I don't think kids can lose PR status and still get citizenship, but I think dad could sponsor them again once a citizen and apply for their citizenship after they land as PRs again if they are still minors.

Agreed they still need to be PRs to get citizenship regardless and that part is not clear to me whether if they never really reside in canada how they would retain PR. I interpreted the rule about minors not needing to meet the residency requirement for citizenship to mean they still need to be PRs at the time of application but they still need at some point to meet the PR residency requirement to not lose PR status, sort of a contradiction but I guess is intended to avoid a child never really living at all in the country or maybe having any intention as a minor but still applying for citizenship with a parent. Maybe I got it all wrong and will to admit that.

So for me anyway thats how I would interpret it the child needs to meet PR RO but not necessarily the citizenship residency obligation when a parent applies for citizenship at the same time meaning the child cannot live outside Canada and get citizenship unless maintaining as a minimum PR

They don't control when you enter and leave Canada and revoke PR automatically. Maybe if the kid comes to visit the parent in Canada and the CBSA officer sends the information to CIC, but I don't think they would do that for a minor.
