Additional Documents and/or Information Requested by CIC

Dear All,

My husband is working in NOC 2225 since September 2011, this is Lawn Care Specialist occupation. However due to weather conditions it is not all year round work- that reffers to the NOC category description. When winter season he is preparing lawn care equipment, repairing it and does delivery of other products that company sells- this actually is not considered as description of NOC 2225.
We have applied last year in March for CEC (then he had already more than 12 months full time work, even without winter months), today we have received following email from CIC:
"I note the duties and duration of work listed in your employer reference letter dated 2014-02-15, however, I do not find it reasonable that you performed the duties of the NOC 2225 for the duration of your declared work experience as there is the winter season in ON.Therefore I am asking you to submit any additional information and/or documentation that would allay my concern(s). You have 60 days from the date of this letter to submit the additional information and/ or documentation to the above address."

Now, my concern is following; I agree that all duties of winter work are not specified in the NOC 2225, but we have sent all documents that are supporting CEC requirement of 12 months full time work (qualifing period 09.20.2011- 14.03.2014). If they will take into the consideration only spring/summer season when there is no snow, there is more than 12 months experience in skilled occupation anyways. Can someone advise how to respond to CIC' request for more information? Thank you kindly.

As you are probably aware at this point, if you had explained that in your initial application/letter of employment, this could have been avoided. Now your main worry isn't just proving 1 year of skilled employment, but allaying the VO's possible concerns about misrepresentation.

Your best course of action will be to get another letter from his (former?) employer that accurately describes the seasonal nature of the work, and if possible, give more precise dates for each season where he performed the duties of NOC 2225.

Thank you Jes- ON on suggestions and great comment.
I agree with you that was a mistake in LOA, not defining nature of the occupation. We will request his employer to define more precisely nature of the work and write another polite LOA explaining his occupation details.
I will also hire an immigration consultant to review the letter prior sending it to CIC, since we don't want to lose this opportunity. It is our second CEC application.

In the submitted LOA, employer is mentioning that he is working in the shop- maintaining equipment during winter season. So could you please clarify, would misrepresentation would be describing the work that is not the part of the NOC code?

Well, that is good! No, it is not misrepresentation since it was already part of the application. So it is still better if you can get it from your former employer, but you could possibly write a letter of explanation, pointing out that the seasonal change of duties WAS mentioned in the original letter of employment, and give your dates for the seasons in which NOC 2225 applied, and that he met the 1 year requirement...
