Hey guys, thank you in advance for helping.

My fiancee and I are about to get married in few weeks. She is a Canadian citizen and I am Montenegro (Europe) citizen who is in the US on expiring student visa.

My question is if we were to get married before my visa expires in the US, would the processing time be quicker if filed from the US or Europe? Also, and I'm sure there's information out there, what is general time frame for receiving of PR if filed outland?

Thank you so much,

Eko

If you have been admitted to the US with a visa for more than a year, you could file through the US, but since you will loose your status after that, I don't think it's a really good option (if you overstay your visa, you will then get banned from a US for a long time...).

Current waiting times can be found on CIC website here http://www.cic.gc.ca/english/information/times/perm-fc.asp

First stage is 35 days for now, and then it depends on the VO for second stage. As a national of Montenegro, your office is Vienna, listed at 10 months, and US is 12 months, so it seems like a better idea, for all sorts of reasons, to go through Vienna. Some people get done faster than the time indicated on the website, but you can count on that, and hope that it's done before...

If you want to stay with your partner, you will need to apply for a visa as you are not from a visa-exempt country. see here http://www.cic.gc.ca/english/visit/visas.asp

You can apply for a visitor visa but most spouses of canadians are denied as CIC doesn't believe that they will leave the country when the visa expires. AS your future wife is a Canadian citizen, she can be outside of Canada and stay with you for the whole process, she will need to prove in her application that she will return to Canada once your PR is approved.

Good luck,
Sweden
