In the guide of H & C , it says if you are a designated foreign national, you may not apply for H&C for at least 5 years after the day of your designation
My question : The asylum seeker who come to Canada by crossing the Roxham Road in New York state. If his asylum were rejected in Canada. How long he need to wait for applying for the H & C ? 1 year or 5 years?
Does he belong to the designated foreign national ?
He is not American citizen
