About outland application, affidavit and dependent children forms.

Hi,

My partner and I are applying for sponsorship family class. We have a few questions about the application.

I am the sponsored person and live with him in Canada. Now we are considering between outland application and inland application. But I'm not sure if I want to use outland application, which packages on the website I should use. Should I choose Application for Permanent Residence in Canada—Spouse or Common-law Partner or Application to Sponsor a Member of the Family Class? I think I should use Application for Permanent Residence in Canada—Spouse or Common-law Partner, because I reside in Canada. But I'm not so sure.

The second questions is that I was on a study permit, when I first came to Canada. At that time, I got my police certificate and birth certificate translated by a notary public. However, yesterday I checked application package for applying family sponsorship. It said that all the translation should accompany with an affidavit and a certified copy of the originals. I'm confused, because at the first time, my both certificates didn't accompany with an affidavit and a certified copy of the originals. So do I have to have an affidavit and a certified copy?

The third questions is that we don't have any dependant children and representative. Should we still fill out the forms: Additional Dependants/Declaration [IMM 0008DEP] ; Additional Family Information [IMM 5406] ; Use of a Representative [IMM 5476] ? Or we should still include them in our package but write N/A in each forms?

If you are currently in Canada, I would advise to do an INland application. Takes longer than an Outland, but you can begin working after 6 months (you get AIP) if you file an Open Work Permit with your application. But that is my opinion. The downside of the inland is that you are not advised to leave the country.

As for the online packets, you will need to use both the Application to Sponsor a Member of the Family Class, your partner will fill this one out, and you will fill out the Application for Permanent Residence in Canada—Spouse or Common-law Partner.

Those three forms you mention, IMM 0008DEP, IMM5406, IMM5476 are not really necessary for you. However, you may need to use the last form if you plan to have someone fill out forms for you or speak on your behalf (not sure if you will, just thought I'd mention it).

Forgot to mention that Outland is quicker, you CAN leave the country, but you will have to wait until you are given PR until you can begin working.

Thanks a lot. But I don't quite understand why we have to fill out the two packages. These two packages are basically the same thing, right? The difference is that one is for the applicant living in Canada and another one is for the applicant living outside of Canada. Both packages contain the forms for sponsor and sponsored person. Do you mean my partner can fill out the sponsor part of " Application to Sponsor a Member of the Family Class" and I fill out the sponsored person part of "Application for Permanent Residence in Canada—Spouse or Common-law Partner"?

If you are applying outland you click on "Sponsor your family" under If you are applying from outside Canada

And if you apply inland you click on "Sponsor your family" under If you are applying from inside Canada

As for which is better, inland vs outland, perhaps if you mention which country the applicant is from people could better advise. Whether or not the applicant is from visa-required, or visa-exempt country can influence decision a lot. In many cases and depending on the visa office, many outland applications are completed and a full PR issued, in around the time it takes to do just sponsor approval for inland application.

Hello again, thanks for all your help so far but we're still confused. ::)

Here are the facts, maybe breaking it down will help you understand our question.

1. We want our application processing to go as quickly as possible, therefore we want send our package to a foreign visa office (Beijing).

2. We understand that there is an application package for applicants already living in Canada, and a package for applicants living outside of Canada. We live in Canada so it would logically follow that we use the package that states that we live here (the "Application To Sponsor Your Spouse, Partner or Children"), but there's still something we're confused about...

3. We read that the "Application To Sponsor Your Spouse, Partner or Children" is sent to the Inland processing office in Alberta, but we want our package to be processed outside of Canada, in Beijing. So...

4. Should we use the "Application to Sponsor a Member of the Family Class", which is for applicants living outside of Canada, even though we're both in Canada, because we want it to be processed in Beijing, outside of the country? Or should we use the "Application To Sponsor Your Spouse, Partner or Children" and somehow specify that it should be sent out of the country to Beijing?

If you want to go through Beijing office, you MUST select the package under "If you are applying from outside Canada". It doesn't matter if you are actually in Canada now... you treat the application as if it's from outside Canada, and use ALL the forms from the outside-Canada section. There is a question in one of the forms, on which outland office you want to use. So you would write Beijing here.
