A question......Implied Intent and PNP

So, the PNP application for my employee is nearly completed and should be sent in the next 2 weeks to BCPNP.

The work visa for the applicant expires middle of May 2010. As the BCPNP is currently taking 20 weeks or so, we need to file a work extension. Do we send the extension of work visa, quoting the expected PNP nomination instead of a LMO?.....and if so....does this give the applicant implied intent until the PNP nomination comes through?

If the work visa is opened and the PNP nomination is still not available, does this mean the applicant has to stop work and leave Canada?

Or....can we at the same time file for a TRV, so if the PNP is not through by the time the work visa is opened, the applicant can still remain in Canada as a visitor (stop working of course) until the nomination is confirmed?

Goodness, I thought I knew a lot about immigration but now faced with this new challenge I find I am still a baby at some of the workings.

Hope BCGuy can help on this one. :D

Hi,
I had similar questions and found out PNP letter was not accepted for application for extension of TWP, a new LMO was required, we went to a port of entry yesterday with all our documents! We are now seeking LMO via my husband's employer. Our permits are expiring April 15th, so timeline is tight, but we are hopeful that if we go to POE again with positive LMO we will be successful. Our PR application was submitted last August and Medicals were just completed so it could be another 6 months before we know if we will be approved for PR card.

ALSO - IMPORTANT!
You only have IMPLIED status once CIC have received your complete application (including new LMO) for extension of work permit. You don't get IMPLIED status because you have a PR application in process. It is the applicant's responsibility to remain 'IN STATUS' while a PR application is in process.

Sorry to correct you But the BC PNP letter of support specifically states that no LMO is required for your work permit.Funny I think the Manager of Strategic Occupations of BC PNP would be quite shocked that they ignored the BC letter of support,Please contact me by PM so that I can refer you to the Managers of the program Addendum I just called them please call BC PNP at 604-775-2227 and explain to them what happened,the regulations are very clear

yes there is no implied status,thats why they usually apply for visitor status to await the result of the BC PNP,I have had NO DENIAL of visitor TRV in 28 BC PNP cases to date
