Hi folks,

Now I expect that I will get AOR soon, so I wanna apply for BOWP after getting AOR.

And my wife open work permit is already expired so she has not hold any valid visa. but we are from S. Korea so that we can stay here without visiting visa.
Question is: when I apply for BOWP, Can she apply with me even though she has not any visa?
or does she need to restore her expired open work permit before applying?

Dependent spouses are given a open work permit based on the primary applicant's BOWP. She will not need to restore her status to a worker as long as she changed her status to a visitor when her WP expired. For visa exempt people, a simple cross border trip should change the status.
