I am a Canadian Citizen living and working in the USA with my husband, who is a citizen of Kenya. I want to sponsor him so we can return to Canada with our 2 children unfortunately he has a few belmishes on his criminal record. He was charged with a DUI in Jan 05 and got his license suspended for 6 weeks and then he drove on a suspended license, which in Massachusetts gets you a manditory minumim of 60 days in jail. He served his time and completed his probation without incident and hasn't had any trouble before or after this. Do you think that his application for PR will get rejected? I can't seem to find any info on specific offenses...it's all very general info and doesn't look promising. Can anyone help??

He is inadmissible to Canada and has to apply for rehabilitation. He will not be eligible to apply for rehabilitation until 5 years have elapsed from the end of the DUI sentence. See: http://www.cic.gc.ca/english/pdf/kits/guides/5312E.PDF His only faint hope is that you submit a sponsorship application http://www.cic.gc.ca/english/immigrate/sponsor/spouse-apply-how.asp for him and that CHC may issue a Temporary Resident Permit for him. A very long shot.

Actually, I don't think it's a requirement that you file a sponsorship application for him first before he can be assessed for a TRP. You should read through this Temporary Resident Permit manual for more info.
