My wife received one of those We're-Almost-Done-Your-Application-So-Please-Send-Your-Passport emails today, which of course is great news.

I have a few questions about the email they sent.

  • the email gives different instructions for visa-exempt countries and non-visa-exempt countries. It asks: "If you are a citizen of a country that is required to obtain a visa to visit Canada...", and then it says,
    If you are a citizen of a country that is exempt from obtaining a visa to visit Canada..." Actually, my wife is both. She's applying out of Brazil (a non-visa-exempt country), but she also holds citizenship with Italy, a visa-exempt country. Which instructions should she follow?
  • the email asks for "Two (2) recent photographs of yourself, your spouse or common-law partner and dependent children (if applicable)". I assume this means photos of just her, since her spouse is the sponsor and not an applicant, and she has no children. Correct?
  • the email says she can submit her passport to Ottawa if she is "currently in Canada and plans to be in Canada for at least three months". Well, that's true, since she's currently in Canada under a visitor's visa. Then, the email says "If you live outside Canada...submit your passport to the Visa Office in Brazil." Well, that's also true. She's here in Canada as a visitor, but she still officially resides in Brazil. So, can we send the passport to Ottawa?

For the passport, she has to send the one that she used on her application, I am on same situation but currently using the visa-exempt passport. If she's here then she can send it to Ottawa, they will send it back in 2 weeks or less.
 
1. you answered your question in the 3rd question. what visa office is processing her application? THAT is the passport they are expecting, so if it's Brazil, she needs to send in her Brazilian passport - this is what her PR status is connected to.

2. correct, they only need pictures of the PR applicant. the spouse they are referring to is when a husband and wife are applying for pr at the same time. this does not apply to spousal sponsorship.

3. Most countries won't allow the Passports to be mailed outside of the country so that is why the letter is giving options. Even though her legal residence is Brazil, she is currently NOT there and can't receive the passport back from the Brazilian visa office. since she is CURRENTLY in Canada and plans to be for at least 3 months per the instructions, the passport goes to Ottawa.

She's applying outland, from Brazil. The visa office is Sao Paulo. I am aware they are expecting her Brazilian passport, but the email said we could send it if she was a residing in Canada. Currently, she is visiting Canada but is technically still a resident in Brazil. Hence the confusion. (Another part of the email said to send the passport to Ottawa if she is "in Canada". Which she is -- but as a visitor, not a resident.)

Oh...interesting. So we should definitely send to Ottawa?

    I disagree with the other posters. I would send just photocopies of both passports and a letter of explanation that she will travel to Canada using her visa-exempt passport.

    Send it to Ottawa.
