Hello,
I apply for an extension of my work permit. They refused and gave me 90 days for the restoration. These 90 days passed... Can I apply for work permit from inside Canada? What can I do to stay in Canada at all?
Thanks

You're out of status. So no - you can't apply for a work permit from inside Canada.

If you failed to apply for restoration within 90 days, then there's nothing you can do to restore your status in Canada. You'll have to leave and then return.

hi scylla

me too same situation. way back 2009 my new employer failed to re apply my restoration and that's why my work permit was refused because he submitted by 90 days passed. so dec 2009 when i was received a letter that i was out of status i decided and went home to the philippines january 2010. right now i was 2times refused for the work visa since i applied twice 2010 ,and the second time 2012.

what are my chances to get back to canada since my prospective employer got already LMO for me ,right now i have on going application process for work visa here in the embassy of the philippines . would my overstay is the reason of my 2times refusaL and how can go on and move forward? thanks hope you will enlightened me

Yes - your overstay can cause future visas to be refused. I would recommend that you wait a few years and really re-establish yourself in the Philippines before you try applying for a work visa in Canada again.

Alternatively you can apply to immigrate to Canada (if you qualify to apply). Your overstay will have no impact on your immigration application.

hi scylla thanks for reply,.

can i ask again a question, actually i came to canada as worker april 2007 to april 2008 as food counter attendant at KFC fortmc murray alberta. then from april 2008 t0 2009 luckily my employer got renewal of my work visa as food counter attendant again but then the 3rd times was refused so i decided to find another employer from may 2009 and found prospective employer by june 2009 and i introduced to my new found employer what is my status of my previous employer.he assured to me that he will process my restoration and LMO and new work permit for him ,formally i had a letter from the employer stated of what he promises that's why i entrusted to whole process but unfortunately i found out that the agency he hired to process my legal papers was fooled him. That's the reason why my restoration and work permit submitted after 90 days passed.

So how can i immigrate to canada, what are the qualification? i only had 2yrs work experience. i've been here in the philippines 3yrs and 6mons since i left canada. thanks for reply again scylla.

. Again, I did not intentionally want to violate any conditions of my admission to canada. I just mistakenly entrusted the whole process of fixing my status to stay. However, never did I intentionally violate any lawful orders, as shown by my immediate departure from canada to philippines.
