Hello.

Form 5406 in the immigration forms states that; The principal applicant, their spouse or common law partner (if applicable), and all children 18 years of age or older must complete their own copy of this form.
I am the sponsor but also the spouse so do I have to complete this form? And my wife has one son 22yo who not immigrating with her, does he need to complete this form also?

Thank you

no, you as the sponsor do not fill out this form. anytime an applicant's form says "spouse" or "family member", this does not refer to a sponsor or family members not included in the sponsorship. this refers to when a couple is both being sponsored by a third person, or there are dependants also immigrating.

as for her son, i don't think so either, because i think he is now too old to be considered a dependant? the rules just changed about that, so if he is in fact too old to be a dependant, then no. if he is not too old, and is considered a "non-accompanying dependant", then yes. she would need to put your name and her son's name on her form.
