H&C is for people who cannot be sponsored by their spouses. Since she can be sponsored by her spouse - she needs to apply through spousal sponsorship. H&C won't work.
The challenge she faces is that since her refugee claim has been denied, her passport won't be returned to her until she is departing Canada. I'm not sure how you apply for spousal sponsorship when your passport is being held. You may want to ask this question in the Family Sponsorship section of the forum.
It's too bad they didn't apply for spousal sponsorship from the start. Everything would have been much simpler...
