3rd TRV Rejection (Despite Valid US Visa among others)

Please help. I am desperate.

2011 - Visited Canada successfully without overstaying or anything. Fresh graduate at that time.

2012 - Aunt in Canada tried to petition me but was rejected/failed.

2014 - Employed for 3 years. Multiple non-Visa travels around Asia. Monthly salary of 500CAD. Around 10,000CAD in bank savings. Amortizing a condominium monthly. Was supposed to join family and relatives for a trip to Vancouver and Alaska. DENIED.

2015 - Held a valid but unused US visa. Still paying for the condominium unit. Less than double the savings. Monthly salary of 1500CAD. Was supposed to attend sister's graduation together with family members. DENIED. Reasons: Family Ties in Canada, Limited Employment Prospects, Current Employment Situation, Personal Assets and Financial Status.

2019 - Visited US in 2015, US Visa still valid. Expired and used Japan and Korea Visa. Monthly salary of 2300CAD (which is roughly 4x the going average in our country). Savings of 20,000CAD. New car through car loan. Condominium unit now fully paid through bank mortgage. A lot more travels (almost at least 3x a year). Going to attend a friend's wedding and visit relatives. Going to Canada with mother and sister. Attached a letter stating we will not appeal the 2012 failed petition. Plane tickets already bought, we even got Premium Economy seats. I work as an executive assistant.

DENIED. Reasons: Travel History (WTF?), Purpose of Visit, Limited Employment Prospects, Current Employment Situation, Personal Assets and Financial Status.

Can anyone tell me what exactly Limited Employment Prospects and Current Employment Situation mean? I earn so much more than the usual employee in our country and I have been working in the company for 5 years. My salary and savings basically doubled since the last time I applied. Is a house and a new car not enough proof of assets? This is a 3rd world country where people don't even normally own houses.

How can I change their mind?

I would order your GCMS notes to find out the detailed reasons behind the refusal.

My sense was that it was probably a bad idea to attach the letter stating you will not appeal the 2012 failed petition. This may have worked agaist you by drawing attention to this petition and making IRCC concerned you still have plans to remain in Canada long term. There was no point to the letter. It's way too late to appeal. The appeal window was open for a very limited amount of time in 2012.

How long a trip did you request? What evidence did you provide to show your employment and assets? Did you include a leave letter from your employer?

Were your mother and sister approved or do they already hold valid TRVs? Or do they live in Canada already?

I guess they think being an executive assistant is a volatile career, especially in your home country, and they do not see anyone staying there in the long-term favourably.

We attached that letter because we couldn't think of any other reason why my applications keep getting denied. We surmised that I was always going to be on a "blacklist" unless I categorically state that I have no plans of migrating to Canada anymore.

I was traveling and earning way above the average citizen of my country. I never overstayed in any of my travels and most of them are with my family. I can prove this by either sending tons of family photos abroad or attaching their passport scans but this doesn't sound sensible. I don't know anymore how to paint a picture of what our family is really like, that we're just like any other family, who travels to have fun.

Us adjusting the 2015 trip to accommodate my situation should be enough evidence to show that I wasn't simply using the graduation as an excuse to enter and stay indefinitely in Canada. We pushed through with what we had, which was a US visa. Would someone who simply wanted to enter Canada waste all those money by spending 2 weeks in the USA? The trip would have been cancelled entirely. This is common sense to me but I don't know how to convey it in terms of documents.

The trip is 3 weeks. I included an employment letter with my compensation but did not include an approved leave letter which I intended to include now.

On top of the employment letter with my compensation, I submitted my 6months bank records, income tax returns, car registration and car loan approval, full payment receipts from the developer for the house and home mortgage documents.

My mother and other sister's visas from 2015 are now expired and are now in the process of renewal. On top of my plane tickets, I included theirs, their passports, their US visas and their recently expired Canada visas. I also included photos of the 2015 US trip we took. I'm contemplating to include photos of the actual graduation in Canada where I wasn't present.

I am also writing a letter now to explain my situation because apparently photos and passport stamps aren't enough. My aunt is also writing a letter of guarantee stating she will ensure my return to the country. She herself is a federal employee. In my application I did not ask her to write an invitation anymore because my friend and my sister already wrote theirs. This time there will be the 3 of them.

How long does it take for the notes to be released to them once they request for it?

Your aunt’s Letter is pointless so no need to include it. It isn’t actually enforceable.

Probably not much but wait a few years until you have substantially more ties to your home country (e.g. spouse, child). It's generally quite difficult to get a TRV to Canada as a younger single individual from the Philippines.

The petition by your aunt has likely damaged your chances of a future approval since it demonstrates an intent to remain in Canada long term. So you have to work even harder to overcome this.

She's single, younger than me, barely have any savings (Mom is financing for her), basically the same travel history as me, no assets in her name. But they approved her! She's barely 2 years in her work and earns 1/6th of what I earn.

They have no consistency whatsoever in evaluating applications. The more I think the failed petition did me in.

Again, the failed petition demonstrates a strong intent to remain in Canada long term. If you were the only one sponsored by your aunt (not your sister) - there's the huge difference between your two applications.

Emotional letters do not work. Zero point including them. Agreed this will be overkill and make you look desperate. The failed petition by your aunt already does that - you don't need help in that department.

As of now, on paper, you are more likely to stay indefinitely than your sister. The strongest sign of a desire to remain in Canada is filing a permanent residency application - which you have done. I think you are vastly underestimating how much damage your failed aunt's petition has done to your TRV application. What makes it worse is that you didn't meet the requirements to be sponsored. This increases the sense of desperation that an IRCC officer reads in your profile.

Why are you so desperate to visit Canada now? If I were in your shoes, I would say screw it and go visit someplace else.

I’ll comment on your statement saying buying a house and car means you do not plan to stay in Canada illegally. Just to provide a better understanding of how the VO’s mind works. I am in no way insinuating you plan to stay illegally, please remember that.

Okay, so I’ve been here since 2017 only so my experience may be a bit limited BUT out of ALL the Filipinos I have met here, 100% bought multiple houses and cars in the Philippines. My spouse and I have 3 properties and 5 vehicles that we left in the Philippines. The visa officer would know about this culture which is why buying a house and car will not help your application. They know that most Filipinos use Canada to earn money and then retire in the Philippines which is perfectly legal but just shows how having property there has no bearing.
