Hi there,

Firstly, Wish you a very Happy New Year to All.. In my situation, I have heard a lot of suggestions and I would appreciate if you guys can guide me with right advise based on your knowledge and experience.

I am a permanent resident in Canada, and I met my love in September 2015, she is currently on student visa for one year expiring in May 2016. We both went back to met our parents in India, we are now engaged.

We are planning to come back to Canada and later get married and move in together in about March or so, and file up the inland sponsorship for her. The situation in which i seek advise are:-

1. Shall we apply to extend her study permit for one more year which will lead to 3 year post-graduate work permit, while awaiting for the spousal application. OR after the completion of one year study just apply for the 1 year post-graduate work permit and later if required one year open work permit under the spousal visa application.

2. Shall we get married and apply for the spousal immigration visa application before the application of study permit or work permit. OR after the work permit or extension of study permit is granted.


Me and my fiancee is looking to start a health and better life, and we both agreed it will be best if be both be working full time after her study is completed. But the argument of one year study will lead to only one year work permit and so on, and the processing for inland is more than 2 years. We like to keep things easy and smooth. I would really appreciate any insights and experience if you can share.

Hello!

A nice easy question for you all :)

Once I receive my OWP (which will be sent off with my Common-law application), would I be able to leave Canada for holidays ect whilst the PR application is being processed? Reading conflicting info.

It is not recommended. If you returned and were denied entry at the border for whatever reason, your entire application would be cancelled. You may want to consider doing an outland application.

Thanks. I managed to find a load of responses to similar queries on this forum and others and as you say it can't be guarenteed you'll get back in so it's not advised, but it seems as long as everything else is in order and are from a visa exempt country there's little chance you'd denied.

Thanks for clearing it up though :) As for outland - UK visa office are taking 17months, inland 25 months. But with inland I can apply for the OWP... Hoping I'll have a WHV soon too, so i think for me inland would be better :)

Is there anyone know if common law usually take more time than married status? Anyone have experience in processing fast?

If you qualify for a working holiday, then why do inland if you don't need the OWP? You'll be able to work either way. Would you only get one year for the WHV?

I'm currently in the pool awaiting for an invite, but there's a 5000 cap so not 100% certain I'd get one. But since looking at that spreadsheet and if I get one, I'll doing going down the Outland route! Thanks for that.
