Hi, all

just wanted to open this topic about refused refugee claimants who applied inland spouse sponsorship.

my wife and I applied for inland Aug, 2011. it has been challenging but we are hopeful there is a light at the end of the tunnel. so if you are in a similar situation please feel free to comment.

I guess there aren't many refugee applicant that applied for spouse sponsorship?? ???

Hi, My husband is also a refused refugee claimant, but we are probably less successful then you are. We sent the app on Sep 13, 2011. It was received on Sep 29. In the end of August this year (2012) we received a letter that the file is sent from Vegreville to Vancouver. That is the status now. I don't know why it was transferred. Any hints?

Also, i wanted to ask you how are you dealing with CBSA. Did they agree to wait till you sponsorship will get processed? They are quite harsh with us. They are trying to deport my husband, and didn't deport him yet only by the reason that his country (Cuba) does not accept him. If you know about any other cases like that, please let me know. Thanks

Very sorry to hear that. Can you please answer a few questions. Did you call Immigration and ask for the reasons of the file transfer? Can you give a more precise date of when the file was transferred? I am also wondering, how are you dealing with the border agency? Did they agree to wait with removal until your sponsorship application gets processed? Thank you for the information
I read somewhere on this board that if the file is transferred to another office, it can take an year or two... I find it terrible

sorry for the late replay! yes unfortunately I have to deal with CBSA too, I have to go to do a report every month until I become a PR, and as you said they aren't really that friendly.
the reason they transfer the file to the local office usually is if they have doubts about genuineness of the relationship, however that doesn't mean they will refuse your case.

so when you go for the interview make sure to take as much evidence as possible to show you have a genuine relationship. they especially get doubt from refused refugees because of their status. so when you go take lease/rental agreements banks statements, pictures of trips of you two together and more. the more you have evidence the better.

I think the reason our file didn't get transferred to local office for review was because we got married 2 years before my Wife and I applied for the sponsorship, and we were together as boyfriend and girlfriend for good while before marriage and we had lots of picture from long time ago when you could clearly see different stages of our lives together. we also sent in our rental agreements and tax stuff.

so just be positive and hopefully it will be over with. take as much evidence with you as possible that the key to show them that you guys really are genuine together.

again as I explained for country girl, evidence is the key!! so make sure to take all the evidence you can of your relation to proof to them your relationship is genuine.

in my case the when I got the AIP when I went to CBSA to do my report I told them I have received the first stage (AIP) and I asked "do I still have to report to CBSA?" and they said yes I have to until I get approved for PR then I don't have to anymore.

from my understanding they Can Not deport you if your file is still in process for sponsorship as long as you applied for sponsorship before the deportation order is in final stage.
if the deportation order is in final stage then it still can be appealed when they give you a form to fill out and you can say that your file is in process of sponsorship and they will review and make a decision.
I could be wrong but I'm assuming since he hasn't been deported and your file is still in process, most likely they won't deport him unless the application fails.

how do they say they wanna deport him? did they give him a final stage deportation order that is enforce? or they just asked him to leave?

Hi,
I just read your posting now and i feel i should share mine with you, for me i apply before my refugee case was denied and after they send us a letter that they have received our application, i was denied about four month later and i call the office for which some one told me that CIC will wait until after a decision has been made before any action will be taken, so i waited and in feb 2012 my esbc said medical has been received and on file but few month later the case worker call me to send a fax to her about my kids that are not in Canada which i did, and when i call, i was told that my case have been transfer to Vancouver for further processing and the office will call me, so i call call center and i was told that all the letter and fax i send were not receive, so i order FOSS with $5 and when i get it a note was on my file that she transfer my file due to fact that she never received those letter and that my passport copy was missing, i used that note to send all the letter i send the first time together with new one and copy of the receipt that cic received it and sign for it, the officer in Vancouver update my file and just last week my file was transfer back to Toronto. I guess what i trying to say to you is to order FOSS from CIC and find out what is on your file so you can handle it. I'm in Ontario keep me posted

When I came to Canada as a refugee I didn't even have a passport, so CBSA didn't have my passport. when we got married and we applied for spouse sponsorship I didn't include a copy of passport because I didn't have one, but when I received a letter from CIC for my AIP in the same latter CIC asked about a photocopy of passport or travel document so I went to the embassy of my country in Ottawa and they issued a travel document for me and I sent a photocopy to CIC. the reason I didn't get the passport was because they are issuing a new type of passports and it takes more than 3 months to get it and I didn't have that much time from CIC so I just got a travel document instead which is valid for 6 months.

I will update you guys!

Wow that's so horrible that they lost the information that you send to them and as the result it made the case so much harder.
now im getting nervous about the photocopy of my travel document that I sent them. I hope they don't lose it, when I read your story it makes me think and I really hope they receive my info and don't loose it.
I'll wait for another month if I don't hear anything for second stage I will order a FOSS note.
