If you are a certified nurse (LPN) with no experience can you apply for canadian skilled worker program?

If you are out of status in the US (due to overstaying visitor's visa) can you apply for the canadianskilled worker program from the US.

Without at least 1 year experience, you would not be able to apply under category 1 as a licensed practical nurse. However, if you have at least a 1 year experience in another skilled profession and you have a job offer in Canada and you have 67 or more points on the self assessment, you could apply under category 2.

You can not apply in the US unless you were admitted on a 1 year visa. If you came as a visitor and overstayed, you would have to apply through your country of nationality.

what if you have are recent graduate.. no experience (lpn) but have a job offer?

when will that law change. "out of staus is out of status" what difference does it make. they should really review that law.

You need to meet basic conditions to apply under the skilled worker program, that is get 67 or more points on self assessment and have at least 1 year of continuous skilled work experience in some skilled job. If you have that, then you just need to fit some category. A job offer approved by HRSDC (AEO) would allow you to apply under category 2.

I don't think there are any plans to change that rule. I think the spirit of the rules was probably not to allow people who are out of status to apply in the countries where they are out of status at all but as it is worded, it has been interpreted, at least by Buffalo that people who were legally admitted to the US at some point with at least a 1 year visa may apply through Buffalo even if they have since become out of status.
