2 PR application?? will it conflict each other

Hi All,

Me and my fiance is getting marry this August, She have already filed for a PR application using the Canadian Experience Class (8 months ago).
We are considering filing a "Inland Application" so she will get a Open work permit. Or do you think is better to file outland.

The question is, will both application conflict with each other. Does the Inland application office need to know if she applied already for PR using Canadian Experience Class??

If she does get her PR from Canadian Experience Class, will the Inland process be dropped or do we need to contact CIC about it and drop the application since she got PR from the Canadian Experience Class??

Please advice on what we should do? I want her to get a open work permit so we can live together, she works far away from the city.

They are different classes of application, so they do not conflict. You cannot have two applications in the same class, but you can apply in different classes simultaneously.

CIC will be able to see both her applications in their computer system. If she is granted PR in the CEC class, then they will discontinue her family class PR application (and vice versa) because to be eligible to apply for permanent residency one must be a foreign national. Once she becomes a permanent resident, she is ineligible to apply for permanent residency in any class. I had something similar happen with my work permit renewal - it was in process and by the time they got to it I'd become a permanent resident so they canceled the work permit application and refunded the fee (because processing had not started yet.)

If I were in her situation, I'd finish the CEC process. First, the published time is 13 months. She's at 8 months so that means she would normally be wrapping things up in July/August, with a COPR issued in September timeframe (13 months) if not sooner - unless there is some complicating factor. The PR she receives via CEC is unconditional - not the "skim milk" PR that one gets through family class when the qualifying relationship is less than 2 years. Further, if you applied for inland PR in September 2013 (you'd need the marriage certificate back to apply) she'd get an open work permit in March 2014 - far past the time she would expect to have PR with the CEC process.

Others may have additional feedback. Of course, you can (and should) consult with a qualified attorney - I'm certainly not one and while I've been in a similar situation (multiple pending applications) others likely have additional insight.
