2 months to meet Residency obligation and need TRV/TRP for kids too...!!

Hi all,

Me,my wife and a child have PR status since may 2013,we stayed for a month,then we came back to dubai,my wife and son stayed in dubai ever since,while I went back to Canada,stayed a total time of almsot 1 year then came back to stay with my family in dubai over a year now, during these 3 years we were blessed with 2 newly born daughters in dubai ,(no PR or Canadian citizenship) we are not from a visa exempt country as well, now we sincerely plan to leave for Canada for good,but a friend of mine here in dubai shock me with a news that we might not be able to get TRV/TRP for the 2 daughters so we can sponsor them to get PR once we arrive in Canada.I have few inquiries on how to get the best option and supporting document to apply for TRV/TRP and inquiries about filing them as well.

1- My friend told me my wife (she sponsor the children on residence visa in UAE) have to resign and sumbit her approved resignation and canceled UAE visa so visa officer can know we are serious about leaving to Canada for good, is this possible!!, what if the TRV/TRP rejected.!! my wife will lose her job and kids lose their residency in uae and canada as well...!!.

2- Do I have to purchase one way nonrefundable tickets. why if i buy refendable ones instead..!!

3- I been told the processing might take 4 week although on cic website it says 15 days but since my wife was away for 3 years and our nationality always be under further scrutiny ,I was thinking to do MEDICAL EXAM for the 2 daughters from an approved panel doctor by CIC then include it in the application to resuce the time of preccing then doing medicals. is that acceptable to the visa office, will the doctor even do the tests without CIC notifications..!! how would he send it to them though..!! please advise.

4- I would highly appreciate if someone can draft me an explanation letter to attach to the application ,what should I mention and can be in our favor and what not to mention that might harm our application.
like,if i show them that i taken some courses at a college while i was in toronto,would help..!! or my driving license in ontario,to show them i am serious of establishing live in canada......as of my wife, her father died of cancer disease,may GOD have mercy on his soul, in 2014 after 6 months struggle with it,and my wife during and after have taken responsibilty of her own family since her father lost his job while being in hospital,also my wife was getting her bachelor since she have a diploma,and the diploma is not acceptable in her profession authority to apply for licensing.for these reasons my wife had to stay 3 years out of Canda,but now we want to return before voilating her residency obligation which is due in 2 months time.

5- should I mention in the TRV explaination letter, that this TRV application to be considered as TRP or let them decide,but in this case and in the TRV application there are questions like what is the purpose of the visit ( i selected other and explained that PR parents want to sponsor kids ) and duration of the visit, i put a 1 year duration, is this right or wrong?.

6- at the start there is eligibility questionnaire ,at first i wanted to make 2 separate applications for 2 daughters,then while completing the 1st application,a question asked would u like to add another family member and i thought this will save time,now i have one TRV application but it seems like 1 daughter is accombaning the other where in reality both of them are accompanying me and my wife ( both daughters are below 3 years of age)....is this correct or wrong, do i have 2 make seperate applications for each child daughter,or leave it as it is, one as visitor the other accompanying ?!!.

7- if GOD forbid, the TRV/TRP is rejected, then i have to go back to canada and apply to sponsor our daughters but my wife ( which will stay with the children in dubai) in this case will loose her PR status for not meeting the residency obligation, can my wife later on,if I succeed to get PR status for the 2 daughters enter Canada along with my 2 daughters and 1 son who also same as my wife exceeded the Residency obligation, can them all enter canada as H&C to seek the benifit of the children and to unite our family again since the PR card itself is up to 2018..!!.

This is probably too complex for this kind of forum. There are many, many angles involved, lots of contingencies, too many IF this, THEN this, but if this other thing, then something else tangents to coherently address the situation in a helpful way.

We are NOT experts. We are not qualified to give personal advice. And this is the type of situation in which there are a lot of details which can make a big difference in how things go, so it would foolish for anyone to offer more than some general observations.

That said, there are some general observations worth making:

Time is clearly of the essence in terms of avoiding a breach of the PR Residency Obligation. More so for your wife and son, given how little time they spent in Canada. Remember, once a PR has been outside Canada for 1095 days since landing, while still within the first five years since landing, the PR is in breach. The expiration date on the PR card is not relevant.

The expiration date on the PR card is relevant for purposes of boarding a flight to Canada. So long as the card is not expired, the PR can board a flight to Canada. Which is a big deal. But if the PR has been abroad more than 1095 days since landing, there is a real risk of being reported upon arrival and facing proceedings to terminate PR status. The longer abroad the greater that risk.

Much of your difficulty involves personal logistics, who can travel how soon, what accommodations need to be made for the children without PR status, and what financial resources you have to do this or that, and so on.

In general, though, the sooner at least you or your wife are in Canada and living in Canada, the better your overall odds of successfully navigating this process toward keeping your PR status and keeping your family together.

That said, your minor son with PR status has fairly good odds of retaining his PR status at least until he is 19 or so even if he remains abroad with a parent; so far IRCC seems to still be fairly liberal or even outright lenient in allowing minors to return to Canada if they do so soon after reaching the age of majority or otherwise becoming emancipated.
