1 year of Canadian experience for CEC category (All seniors help plz)

Dear All/JES_ON,

I received ITA. I am working on my documents. I would like to confirm with all the seniors that I have 1 year of legal Canadian experience as per the below jobs. Is my below understanding correct?

Job1 : Company A
Status: Part time
Contract: 1-Apr-2015 to 08-Aug-2015 (I didn't consider 1-Apr-2015 to 7-May-2015, worked on implied status)
Duration : 8-May-2015 to 08-Aug-2015 (PGWP issued on 8-May-2015)
Total weeks: 13 part-time weeks (13 part-time weeks between 8-May-2015 and 7-Aug-2015)
Hours/week : 18 hrs
Total hours : 13weeks*18hrs=234 hrs

Job2: Company B
Status : Full time
Duration : 17-Aug-2015 to 12-July-2016 (I received ITA on 13-July-2016)
Total weeks : 47 full-time weeks and 1 day
Hours/week : 37.5 hrs
Total hours : 47 weeks*30hrs= 1410 hrs

Which of the below calculation is correct?
(1) 18hrs/30hrs=0.6, 13 part-time weeks*0.6= 7.8 full-time weeks
(2) 13 part-time weeks*0.5 = 6.5 full-time weeks

Case1: Job1 (7.8 full-time weeks) + Job2 (47 full-time weeks) = Total (54.8 full-time weeks and 1644hrs). In this case, I completed 1 year.

Case2: Job1 (6.5 full-time weeks) + Job2 (47 full-time weeks) = Total (53.5 full-time weeks and 1644hrs). In this case, I completed 1 year.

It is not clear why the # of weeks between case 1 and case 2 for Job 1 is different. Regardless, in both cases you appear to have met the 52 week requirement As long as you can document it, there's no practical difference.

I am planning to mention about these jobs in the letter of explanation. I am not sure which of the calculation for full-time weeks is correct among the two. So that is the reason, I requested to confirm about it.

Sorry, somehow didn't notice that. The first calculation is correct; another way to do it is to take the total part-time hours and divide by 30. 234/30 = 7.8 FTE weeks.

(NOTE that if you have some full-time weeks mixed with some part-time weeks, you can count a maximum of 30 hours per week if you calculate this way).

When I submitted the express entry, I selected my NOC code (2121) based on the job title. After receiving ITA, Can I change the NOC code based on duties and responsibilities?

I dropped an email to NOC team and they asked me to use NOC 2172. But my job duties is a combination of multiple NOCs (2121, 2172, 2174). Mostly belongs to 2172. So now I am going to change the NOC code to 2172 from 2121. Should I list duties that overlap with NOC 2172 and remove my duties that overlap with NOC 2121 and 2174 or not required?



Will they treat it as misrepresentation?

I had to go back to one of your other threads to see what your job title and duties are, and have (partly) answered there (no, it is not misrepresentation).

If you change your NOC (and yes, you can), then you should write a letter of explanation (LOE). This is good, because gives you the opportunity to (a) describe why it was difficult to chose the NOC (job overlap with multiple NOCs), and (b) explain why you chose NOC 2172 (advice of ESDC) and include a copy of the email from ESDC.

You do not need to "purge" your job description of the other duties.

In your case, the good news is that all the NOCs you are considering are "skilled" and at the same level. It should be OK.
