Hi Guys,

I started working as Food Service Supervisor in January 2015 but my first three months were probation so my pay-rate was less than median wage, plus it was part-time. In April I started working full-time. I was researching about payrate for cec but found mixed responses. My employer is ready to support me with the paper-work. I consulted lawyer and he said to wait for April 2016 to be safe. I calculated my score for express entry and it comes at 450. If I wait for April 2016, I will be running short of time as my work-permit expires in November 2016. I will meet the 1560 hours mark in December. So my questions are
1. Would it be fine if I applied in January 2016, or should I wait for April 2016? ::)
2. If I do wait for April 2016, when should I start my LMIA process (hoping to get 600 points extra!)? :-\
3. Any other ideas apart from this?

If anyone who has any knowledge on it please reply.

I am not expert but i can try my best to help you.

1. If i would be at your place i would like to be on safe side and apply in april 2016 rather than got rejected later on because of not enough hours. In CEC they consider 1560 hours and also one year experience( because some people can make 1560 hours within 10 months because of over time). you can also discuss and take advice from your consultant

2. Positive LMIA is valid for 6 months and if you are applying in april then you can apply lmia in the december because it also gonna take 4 to 6 weeks to get result which mean you will get your lmia in jan, then you will have 6 months valid till june

3. if you have any previous experience in NOC O, A, B you can also use those months to complete your one year experience toward cec which makes you to apply early and more chance to get PR before your workpermit expire.

Not possible. It is not possible to acquire the equivalent of one year of full-time work in less than one year, esp. if you have some part-time work. You cannot count more than 30 hours per week.

You CAN use part-time work - you count up part-time hours (any week where you work fewer than 30 hours per week) and divide by 30 - that gives you the full-time equivalent # of weeks. Then count the number of full-time weeks (any week where you work 30 or more hours per week) - you need a total of 52 FTE weeks (52 weeks = 1 year) which will take longer than one year.

It would be EASIER to wait until April 2016 and less paperwork, but not strictly necessary. Can't tell you when you would be eligible without the above calculations, or without exact start dates.

Example: Let's say you started on Jan 5 and worked 20 hours a week for 12 weeks, and full-time since then.

240 pt hours / 30 = 8 FTE weeks. So you would need to work until Jan 4 2016+4 extra weeks, or basically until February 1, before you are eligible.

It is hard predict what LMIA processing times will be in the future, but give it at least 4 months. In other words, you could start the LMIA process NOW.

I think I will wait until April 8, 2016 and ask my employer to start the LMIA process. :)
