Some basic information about me: I am a foreign national here in the USA with MS and currently working on H1b. All my work experiences are in the US.
I received ITA on 25th Nov 2020. My CRS was 478. However, when I put my employment I showed my employment as below:
1. Employer A (Internship): 22 May 2017 to 28 July 2018 (68 days)
2. Employer B (Internship + now Fulltime): 16 Jan 2018 to Current (1045 days on the till the day of ITA)
As a result on 25th Nov 2020 My total work experience was 1113 days which is 3 Years 0 Month and 18 days. I was 18 days more than the 3 Y threshold.
However
I did a mistake in putting my work experience. During the transition from my internship to fulltime, there was a gap where I was waiting for my EAD from USCIS. I ended my internship on 13 Aug 2018. I was supposed to start my Fulltime the following week but due to not having EAD, I started my fulltime after I got it, on 24th Sept 2018. So now I have below scenario:
1. Employer A (Internship): 22 May 2017 to 28 July 2018 (68 days)
2. Employer B (Internship): 16 Jan 2018 to 13 Aug 2018 (210 days)
3. Employer B (Fulltime): 24 Sept 2018 to current (794 days on the day I received ITA)
As a result on 25th Nov 2020, My total work experience was 1072 days. 2 Years 11 Months 5 days. Suddenly I am below the 3 year threshold by 25 days.
I have got the reference letter from Employer B where they have explicitly stated dates for my internship and fulltime. Also mentioned that between that brief gap, they were waiting for employment authorization. I have offer letters and pay stub for each of the employment.
Questions
1. Should I decline the ITA? If we remove waiting time, I am below 3 y threshold and would loose 25 points in CRS which puts me below 469 which was the lowest score for the draw in my slot. Do they count CRS score of ITA date or the actual date that I apply and pay the fees for PR application.
2. Since the company has already explained my gap, do I have to show additional proof or LOE explaining this?
3. If my application is rejected, can I apply after the rejection or would there be a ban of some time before I can apply?
Any advice would be greatly appreciated.
