Federal Court strikes down key provisions of Citizenship Act

We shouldn't mix the issues. Like conservatives do in purpose in their propaganda... Citizenship should always be removed when misrepresentation occured before its grant. Because it's a Null and Void Citizenship, it never existed (or should have existed). This has nothing to do with the fact...

Federal Court strikes down key provisions of Citizenship Act

Hi dpenabill. Thank you for your great explanation. 1- Paragraph 155 is not the conclusion of an analysis. It is just a reminder that there is no section on the charter that explicitely says that citizenship is guaranteed as a right (conditional to section 1), as the right to enter and remain...

Federal Court strikes down key provisions of Citizenship Act

Understood. Any right can be violated. But it's still a right. We all have a right to live, but you can be killed by a criminal or a psychopath. What I meant is that, at least, we now have the recognition by a Justice that citizenship is a right, not a priviledge (like a lot of populist bigots...

Federal Court strikes down key provisions of Citizenship Act

It looks like Justice Gagné reviewed the law against the Section 12 related to Crual and Unusual Punishment ONLY. Had the review been against other sections (it all comes down to the case), her conclusion may have been different.

Federal Court strikes down key provisions of Citizenship Act

I respectfully advise you to read the FULL ruling: "....In my opinion, citizenship is a privilege only when it has not yet been obtained.....Once acquired, the rights flowing from citizenship have vested. Therefore, once acquired, citizenship is a right...” Justice Gagné

    Bill C-6: Senate stage

I have been living in Montreal for a long time. Although I agree with all you said in terms of diversity and necessity to provide equal chances to everybody, I unfortunately disagree on the preference aspect. The government and the administrative process may not favor white european immigrants...

    Pro-franco-WHITE-skilled workers I would say. But I agree with you, it's a joke :)

    Bill C-6: Senate stage

I heard good things about the NHS too ! Don't worry, they have the choice between a French version of Trump (Marine LePen) and a French version of Bush (François Fillon) in April. The wonderful Social model that made our pride won't survive that. But anyway, you know that the frogs always...

    Bill C-6: Senate stage

Same here. My French passport was even better ranked than the Canadian one in terms of travel freedom. But believe me, nothing can make you prouder and happier than being Canadian :) especially when you earn it !! :D

    Bill C-6: Senate stage

I don't think Monalisa meant that being British entitles her to anything special. But you reminded me of some fellow French citizens who used to show up in Montreal as tourists and think they were entitled to lifetime residency and benefits just because they were French, thinking Quebec was...

    Bill C-6: Senate stage

He is more progressive, I agree, but in a country where only the Greens stood against the two-tier citizenship law, does it really matter ? Agreed on all you said for Harper.

    Bill C-6: Senate stage

It is very similar in terms of Diversity (having spent some time in London, you're right) , but not anymore in terms of Philosophy. The rhetoric of the current Australian government is just disgusting, while I keep seeing or reading loads of reports about racist incidents in London (especially...

    Bill C-6: Senate stage

Let's not forget that the 2nd generation limit is addressed in MP Kwan's Bill. This Bill looks more like a first patch to the C-6 Gaps.

    Bill C-6: Senate stage

This enactment amends the Citizenship Act to, among other things, (a) permit certain persons who lost their Canadian citizenship for a specified reason to regain citizenship I think it's this one.

    Bill C-6: Senate stage

I am afraid you are :) You need to search C-333 on parliament site and pick the one for 42nd Parliament, 1st session I don't think MP Kwan is expecting the law to pass as is, but rather to draw attention on those important issues and generate debate so they could be included in a more massive...

    Bill C-6: Senate stage

Agreed. Let's hope it will make it to committee. If the government can barely pass one bill per quarter I hardly imagine how an NDP MP can pass such a bill ...

    Bill C-6: Senate stage

I just read the Bill. Very interesting content. However the 2nd generation proposal seems really strange to me. I am not sure how this would help a kid born outside Canada to foreign-born Canadian parents to avoid statelessness.

    Bill C-6: Senate stage

Thank you for raising C-333, I wasn't aware it was already on the table. I will read through it. My thoughts on your question: If the Right to appeal amendements are passed with C-6 then I believe C-333 would be amended at HoC commitee by MP Kwan herself to remove her Right to appeal...
