Reminder: Granting of H&C is an “exceptional relief”

@dpenabill and @scylla are spot-on. Almost 90%+ cases I see on CanLII involves PRTD document versus originating in-land from report 44(1). This is probably in combination that in-land applicant will be less likely breach RO as they can simply wait the clock - OR - the fact that IRCC is more...

Reminder: Granting of H&C is an “exceptional relief”

In reviewing many cases om Canlii - IAD dismiss I would say majority of H&C appeal regarding permanent resident obligations. I actually had not realized how difficult and rare it is to overcome H&C. Too often the excuse of working, allow the kids to complete elementary, not returning at first...

Report 44(1) dismissed - does leaving Canada still pose a risk for RO?

Agreed wholeheartedly. Dealing with 44(1) dismissal really took a toll mentally. It took like over 2.5 years without anyone contacting us, then suddenly given a week to put together a response for an interview in 2 weeks. We called few lawyers who for the most part are not interested to deal...

Report 44(1) dismissed - does leaving Canada still pose a risk for RO?

Thanks @dpenabill and @armoured. Its really helpful. We've been in Canada now over 600 days with current stay over 400 days. Yes, valid PR card. And 44(1) dismissed after lengthy process. Planning to just leave for a week trip.. I think that risk is likely minimal but is still there..

Report 44(1) dismissed - does leaving Canada still pose a risk for RO?

Hi there, We were able get the Report 44(1) dismissed on basis of H&C and immediately asked to apply for 5 year PR. Now the dilemma is that if ones still short say certain days to meet the 730 days, will one invite another scrutiny if we leave for a short trip then returning to Canada? I...

Any tips for first time house buyer?

The rule of thumb is income x 5 is the maximum mortgage you can afford. So $80K * 5 = $400K. A decent 1BR+DEN in GTA (Say Vaughan, Mississauga, North York) probably runs you closer to $600K. So you should have about $200K saved up at this point. Pay attention to property tax, condo...

PR Card Renewal - What happens to current PR Card expiry?

You need a valid PR card to return to Canada. This is required even by the airline before they let you board the plane. If you must leave now, then just apply to PRTD at your destination (which may take time). I recommend not to travel until you have the PR card.

PR Card Renewal & New - 2022 Processing Timeline
