Yes I agree with you. What I was wondering is whether or not they, the foreign consulate, would pickup on the fact that the individual is currently overstaying? I forgot to mention that they have had a new passport issued since the overstay due to a theft so there are no entry stamps etc...

An individual overstays their visitors visa in Canada and plans to leave. However they would like to stop-over in a country that requires a visa to enter. What would happen if they applied for the visa at the countries consulate in Canada?
