    Refusal, what now?

Sorry to hear this. Subject to actually reading the text of the refusal and if it was indeed about the intent to return to Canada: Your 3) would be my suggestion - an appeal's likely going to take longer. (Alternatively you could return to Canada and apply outland for her). Actually going back...

    Quick question about police certificate

I don't know about the Canadian police check (since living in Canada now, does he need to sbumit?). There are several threads here about intent to return for citizen-sponsors abroad: job hunts, apartment searches, other arrangements, etc. If you're just travelling for a while and eg have a...

    Quick question about police certificate

Okay, yeah that's what I was leaning towards. Do you know if they require a Canadian police check from him later on if it would be a problem if he isn't here? And about the intent to return, do you know when that may be required? Thank you.

    Quick question about police certificate

That is a good reason to apply outland, assuming you are a citizen. Note that if you're abroad for long and especially if no longer working/resident in Canada, you may need to provide info about your intent to return. For your pcc, too bad it's sent by mail. Not clear to me either whether...

    Spousal sponsorship

So separate points: -As a Canadian, you can move at any time (of course). -yes, it may take a while. Quite possibly longer than 9-11 months. -assume your spouse is not from a visa waiver country. -Yes, can apply for a TRV. It applies to any applicant. Or indeed any person. There's no limit to...

    Spousal sponsorship

In my letter, I explain that my Russian Temporary residency is expiring, and that I won't renew it. I point them to the included notarized/translated copy of my passport, which shows that my residency is expiring. I also mention that we waited to apply now, as the 12-month window lines up...

    Spousal sponsorship

The road is long and hard. Very difficult to prove intent to return after 15 years, unless you have a job offer or other serious proof or return without your spouse first. This is because ircc views you as established in your country of residence.

    Spousal sponsorship

Thanks Just reading from online immigration content and comparing my own experience from 20 years ago, it is abundantly clear that ircc has tightened its noose for the spousal category, while lowering the bar for work visas. Therefore, simply "a letter of explanation" as to why staying in spouse...

    Spousal sponsorship

On form 5533, where I need to prove my intent to return to Canada, I plan to include this proof - A letter explaining my need to return to Canada. I Mention that my residency is expiring in July 2022, and I won't renew. I make note that we are applying now, so that the expected 12 month...

    Outland Sponsor and Applicant

Anything regarding preps, even if they are preliminary - housing searches, job hunt, quotes from movers, preps for schooling or credentials for work, preps for children. For the citizen, can/will help to show maintenance of ties (bank accounts, savings, financial arrangements, professional...

ALL SPOUSE APPEAL CASES COME HERE AND JOIN US PLZ

I understood what you meant. I know this will be very hard to do or believe at this point, given what's happened, but I think it won't help you to think of IRCC 'trying to get you.' There may be some with fixed ideas about your file - but probably not a plan.

ALL SPOUSE APPEAL CASES COME HERE AND JOIN US PLZ

thank you, sound advice as usual. if u ever come across an appeal based on residency, let me know, would be interesting read. I meant their contingency plan to anybody who decides to join their spouse abroad, thereby making all ircc accusations of non genuine - moot.....so their contingency is...

ALL SPOUSE APPEAL CASES COME HERE AND JOIN US PLZ

Ah, now I see. I think outright refusals on the basis of no intent to return are relatively few - although they can ask for more info. So if you mean that your plan is to move to join your spouse, I think that is a decent approach. If you keep some ties in Canada you should be okay. I think...

ALL SPOUSE APPEAL CASES COME HERE AND JOIN US PLZ

ok for those who live abroad with their spouses, then ircc as no case for marriage not being genuine, but ircc has a contingency plan for that and issues refusal based on failing to prove intent to return. My question is if one goes back to Canada for the appeal hearing, provides a proof of...

Timeline process from biometrics/medical to approval

Yes, it's not that uncommon. Some even apply outland while already based in Canada. Yes, may make sense to consider. Obviously there are other inconveniences (working, health insurance, etc), but you can at least be together. Hopefully yours will go quickly enough that it won't be a major issue.

Are you both outland? Did you get ADR for intent to return? Wow, you application seems fast!

Timeline process from biometrics/medical to approval

I didn't realise my UK spouse on an outland application could wait for part of the time on a tourist visa. We, too, are starting to plan for house sale, mover quotes, getting real estate agents to help with housing etc. in the next six months, but not too sure of timelines, concerned about...

Timeline process from biometrics/medical to approval

I've never heard of someone being denied because they were already in Canada (the reverse for inland applicants can happen if they are out of the country). The process for outland applicants who are in Canada is reasonably predictable and mostly works well, although they are making some changes...

    JULY 2020 *Outland* Spousal Sponsorship

Sorry, not exactly a new office, but handling files from other countries it likely woudln't have, seemingly in a support function (not entirely clear). (I was thinking more of shanghai and guangzhu I think). And yes - it would be one explanation. Of course, other explanations possible too, like...

    JULY 2020 *Outland* Spousal Sponsorship

Fingers crossed ! At least, I will have tried by anticipating that request. Interesting that Beijing is a new office, would definitely explain/rationalise at the very least why they are asking for more.
