Hi experts, I have applied for my mother's H&C application in March last year and after one month she had received her biometrics letter and followed by application received letter. Till then I have not received any correspondence from IRCC. I am not sure if this is too early to expect an AIP or even a decision.

It would be great if anyone in the same boat shares a timeline and I can make an idea accordingly.

Way too early to get to processing stage for most. Many are still under processing at 2 years having not received approval/refusal. Would also warn you that AIP is far from guaranteed especially given the small quota and large volume of applicants, availability of supervisas and PGP which is the proper path to try and sponsor a parent although currently closed. Many are using the H&C program to circumvent PGP which is why I expect IRCC will be forced to address the issue along with other reforms.

I read your replies sometimes and I just want to say Relax Canuck, do you work for IRCC?
I understand that you’re knowledgeable about IRCC processes, maybe through personal experience, but you also don’t work for IRCC. everyone on this forum is looking for some sort of hope at least, I understand you’re being a realist, but relax you’re not an IRCC staff stop assuming, expecting, warning & giving thoughts on behalf of IRCC.

None of us are experts, none of us know how IRCC works or the outcome anyone can expect, we can only compare and discuss our personal experiences, or base it on information IRCC has put out there.

we don’t live under rocks, we understand IRCC is undergoing reforms, I’m also wondering how you manage to go about your own life, but remain active in multiple groups informing people about IRCC reforms & quotas. A simple answer could suffice sometimes, you can advise, give opinion to be helpful, answer questions directly etc

I called my lawyer today lawyer said not to worry wait for H&C. guys i am going to CBSA for reporting every month but they don't mention anything last month about removal. What should i do wait or i should apply again work permit. if someone face same problem so guide me appreciated

Based on your application and accompanying documentation that you have provided, I have carefully considered all information and I am not satisfied that you meet the requirements of the Immigration and Refugee Protection Act and Regulations. Your application as requested is therefore refused.
[X] You are a person against whom a removal order has been made which is enforceable. As such you are not a person who can apply for a work or study permit from within Canada.

I answered someone’s question but also provided realistic expectations because what was once possible in the past will not be possible and many people/communities/consultants/lawyers are telling people that H&C is an easy pathway to remain in Canada especially for parents when that is not the case. Having data of the actual quotas and the backlog of applicants gives people perspective so they can make multiple plans and have a sense of timeline. Not part of IRCC but IRCC has made no secret about the fact that asylum and H&C programs need reforms and from the few insiders I know IRCC wanted to start doing this around a year ago out faced pushback and then delays. On an almost daily basis people ask about why their applications haven’t moved especially within the first 2 years so my message clearly has not gotten through which is why I repeat the same things.

The removal order exists because of the failed asylum claims. That has always existed. H&C applications do not stop removals but they have been traditionally put on hold during H&C processing. It is tough to know what is going on with IRCC these days. Was the WP denied in error or is this a new policy. I would ask for reconsideration based on your ongoing H&C application and attach proof of the application. Unfortunately you must stop working. I would also ask at your next CBSA check-in whether anything has changed in terms of your removal order.

NO i didn't update any document while applying work permit, But last year i updated my H&C 4 times with new documents and updates but still H&C is slow no result yet.

Ok, I would suggest you to apply again (new application) and add your AOR for H&C along with this. Also in the form you can add a note explaining your situation that you do need a work permit and want to be financially independent and pay tax etc.. to give a personalized touch to your application. Moreover you can apply for reconsideration as well, however I would go with a new one.

Think the better option would be to apply for reconsideration first based on the fact that they have an existing H&C in process since processing should be faster. Agree that they can also apply for a new WP with proof of H&C application and mention destitution if unable to return to work with proof of existing family savings level. If you work in an industry where there is need for employees like PSW, nursing, ECE or even construction you can also point out the Canadians will be hurt if you can’t return to work. In terms of H&C applicants Canada primarily wants to prevent demands on social services like homeless shelters, food banks, etc. if people without status are unable to work and if they have no savings. If you can’t support your family and have no savings you may be more likely to get a WP. There is a slight risk that if you are saying you can’t support yourself you could be removed and H&C processed while you are abroad. Really tough to know what is going on behind the scenes with IRCC and CBSA these days because they are trying to reduce the number of temporary residents.

I got my gcms notes today,the file was assigned to an officer on Jan 27 2025,22 months(the average processing time) has passed and still the gcms notes says eligibility hasn’t started,any idea why is that?info sharing complete,criminality has passed,looks like only eligibility and medical is left,my question is if the officer isn’t checking the eligibility ,what is he/she doing then?

if you ever get AIP down the road from assigned to an officer date Jan 27 2025 you should count 13 to 14 months more for them to check everything if they give you AIP after 13 months from that date count another 7 to 10 months to PR file all together from the date you submit until they finish its about 30 to 32 months up to PR your file was sitting there at least 10 to 12 months waiting for officer to be assigned

We have no idea what is really happening with H&C. Are they reassessing the whole program or is it purely due to quotas? There is not point in processing people quickly if they are just going to sit in another huge backlog. Also there may be a reluctance to award AIP because H&C program is likely undergoing reforms and IRCC wouldn’t want to refuse after AIP is awarded because it would likely lead to JR. The math just doesn’t math so IRCC has to reform H&C. I would assume there is likely close to 100k for just general H&C applications at this point and the yearly quota for all forms of H&C is 10k. H&C and asylum programs need urgent reforms. They needed urgent reform a year ago. For a variety of reasons these reforms keep getting delayed and also these are tough reforms to make for a variety of reason. In general until reforms are announced processing times will likely get much longer because the yearly quotas are so small.

Before Immigration reforms when the file is assigned to an officer next step was the decision eaither positive or negative but now everything seems not moving.
