Hi everyone I would appreciate if anyone who has gone through this can reply to this thread. I'm a Canadian citizen who has applied to sponsor my wife from Pakistan, we got married in 2022 and my wife was previously divorced in 2012. We submitted her Nadra Divorce Certificate issued by our Union Council that has Date of Notice for Divorce, Date of Failure of Conciliation, Date of Effectiveness of Divorce, Entry Date, and Issue Date and her Divorce satisfies all the conditions of Muslim Family Law Ordinance and Pakistan Law.
The officer sent us a letter saying our application may be refused and asked us to submit Reconciliation Notices from the time of her Divorce which we will be submitting.
However, the officer says in his letter "In order for a divorce to be valid according to MFLO, you must show that the Entry Date and Date of Notice of Divorce are the same on the Nadra Divorce Certificate, a 90 day period of iddat had elapsed between the time talaq was pronounced and the time the divorce became effective and NADRA divorce certificate was issued prior to your current marriage"
My question is in Officer's letter he says Date of Notice for Divorce must match with Entry Date whereas Date of Notice for Divorce in the Certificate is referring to the Date My wife's ex husband filed/pronounced Talaq (Divorce) to the Union council and Entry Date refers to the Date Divorce was entered/registered with Union Council after it became effective following 90 days of failed reconciliation. It seems as if the Officer believes that Date of Notice of Divorce means the Divorce has become effective (and that therefore it should be same as Entry Date) whereas Nadra Certificate is listing Date of Notice For Divorce as the Date the Talaq is pronounced to Union Council by husband and then you must wait 90 days for it to become effective and then it is entered. Also it appears Nadra Certificate lists the events in chronological order, therefore Date of Notice must be implying the Date when Union council receives the Talaq Notice from Husband and therefore it cannot be same as Entry Date.

My wife's Date of Notice is in March 2012, Date of Failure of Conciliation, Date of Effectiveness of Divorce, and Entry Date is in June, 2012 ( 94 days, passes the 90 days iddat condition). Can anyone who has had Nadra Divorce Certificate please comment, if you can please confirm to me which date the Date of Notice for Divorce is supposed to refer. Is it the day the husband files Divorce with Union Council(which the Union Council is following), or the date the divorce is concluded(which it seems is what the Officer believes).
Also Our Issue date is in 2024 because that is when we filed our application and we needed the Divorce Certificate. The officer is saying it should be prior to our marriage whereas according to MFLO there is no such requirement. Issue Date has no relevance to Divorce time frame, it is the date copy is printed from the computer, if we get a copy tomorrow it would say 2025, but the most important dates regarding Divorce are Date of Notice , Failure of Conciliation, Effectiveness of Divorce, and Entry Date, all 10 years prior to our marriage satisfying the 90 day iddat period.
Please advise how best to convey this to the Officer. Obviously, we will be submitting Reconciliation Notices and her ex husband's written Talaqnama and another paper by Union council which clearly states in Urdu, Today on this such date, the Divorce becomes effective according to MFLO.
Also Our Nadra Marriage Registration Certificate 5 days after our Nikahnama in 2022 lists my wife's prior status as Divorced. If she was not legally Divorced at the time, it would not have been possible to register our marriage in the Nadra system.
Would appreciate any replies how to address this confusion and convey this properly to the Officer.
