It might be best for him to return to his home country first. It seems staying in Canada while reapplying for a new study permit isn’t an option??

They consulted with an RCIC, who advised them to stop attending Heartland, return to their home country, and continue studying an English program there (which is much cheaper). He can then come back to Canada once he reaches the required English level for the ESL program. However, it seems like the refusal rate for study permits appears to be higher now, with stricter rules and many changes.
He needs to work on his English language scores to have a chance of being successful to begin with in Canada as a student.

@canuck78 - will it be best for him to leave Canada now? Or can he still stay here legally in Canada while waiting for his new study permit? Thank you.

The issue is that he is a student on a study permit now going to a DLI that is not on the study permit. Ask RRC if he is studying illegally.

Does your son wants to be successful in his academic in Canada? If not, leaving Canada now is an option.

He is actually my nephew, my sister’s in law’s son.

Update - RRC defer his enrolment until Winter 2026.

Is he allowed to stay in Canada? Or if not, can he stay in Canada while waiting to apply for a new study permit for another school? Thank you.

Deferred enrolment of what the ESL program or 1st year of college? Is he now on a visitor visa that you’ll need to try to extend. Given the costs not sure it makes sense to remain in Canada because I assume English languages courses would also be available in his home country. There is no guarantee his English will improve enough in 4 months.

@canuck78, sorry for the confusion. He has already stopped taking the English program at another school. Now, he is self-studying to meet the English score requirements for RRC’s ESL program this coming May. RRC has given him until March 2nd to submit his latest English test result. If his test result meets RRC’s minimum requirements, they will accept him for the May intake.

If not, can he still stay in Canada (while waiting for a new SP be approved)? He is planning to apply for a new study permit for another school that will accept him to study English. Please advise.

If he doesn’t pass he should return home. He would have already spent 6 months in Canada not studying at the school he was supposed to attend.

@canuck78 Hello! It's me again. Thanks for your insightful response. Is it true that my nephew can stay here beyond 150 days as long as he has applied for a new study permit? They said he can legally stay in Canada while waiting for the result of his new study permit application. Have you heard about that? Thank you.

The issue is he never actually studied under the previous study permit so it should have been cancelled. Did he change his study permit to reflect to study at the 4 month ESL program at a different school? How long has he been in Canada?

Nope he did not change his study permit at all. Only now he is in the process of changing it. He came here in November 27th. His agent said he is okay to stay in Canada because he already submitted an application for new study permit, which I doubt it because I think the 150 days would still apply.

This is a huge mess. He should assume he does not have a valid study permit because he did not attend the first program so no he would not be able to extend his status so the 150 days does not apply. He really should return home and work on his English and then reapply once he has a stronger profile.

We advised him to leave Canada as soon as possible. However, his mother insists that their agent told her he can legally stay in Canada while waiting for his new study permit, since they have already applied for it. They argue that his current study permit has not yet expired. We have explained that the validity of his study permit does not solely depend on the expiry date, as it is currently invalid due to unmet conditions.

We have been searching for any changes in study permit rules but have not found anything stating that one can legally stay in Canada simply by applying for a new permit. His situation is different because he has not started studying at all. We believe the rule they are referring to only applies to those who have already begun their studies in Canada and are changing schools or courses while in the country.

Well, there is only so much you can do.
You have present the fact. The parent ignore it. It's another example of bad immigration "agent".
