Hi Members,

I recently applied for a Canada SOWP from India. My wife has been in Canada for a year and has been working on a TEER 0 job with NOC Code - 20012 (Quality Manager) in an IT firm. With my SOWP application, I provided my Spouse's Employment confirmation letter received from her company mentioning all her roles and responsibilities, salary, office address, and date of joining. Along with this I have also submitted her last 6 months pay slips. Her closed work permit is valid for another 2 years. Still, I got a rejection stating the following reason :

"Thank you for your interest in working in Canada. After careful review of your work permit application and supporting documentation under the International Mobility Program, I have determined that your application does not meet the requirements of the Immigration and Refugee Protection Act (IRPA) and Immigration and Refugee Protection Regulations (IRPR). I am refusing your application on the following grounds:

• You do not qualify under the IMP as you provided insufficient information to demonstrate your spouse’s employment in a TEER 0 or 1 or select TEER 2 or 3 occupation. Refused under R205(c)(ii)."

Request the forum to help me in this case and advise me on what else I am missing.

Order GCMS notes to hopefully get more details about what exactly the issue was so you can address it when you reapply.

I received the same reply. My immigration consultant said the reasons given were not aligning and the application made was not under IMP. We have requested for officer note.

Sometimes VO only select one of the default reasons for refusal when there are multiple ones. This is one of the reasons why GCMS notes often provide a more complete picture of the VO’s concerns. Would be interesting to hear what GCMS notes say so hopefully you’ll update us.

What are your further course of action?

Have you ordered GCMS notes? If you feel a processing error was made then you can ask for reconsideration while highlighting the error.
I have ordered GSMC notes, we are waiting for the same.
As per the new guidelines the primary wp holder should have at-least 16 months of WP remaining for swop application. My closed wp will have a duration less than 16 months after 20th May 2025 and wp is valid until 09/20/26.
With such a tight deadline and given that I am still waiting for gsmc notes, what could be other possibilities?
I was told that we could always ask for reconsideration but the timeline of reply is uncertain.
When i asked about TRV for my spouse and kid, they said the chances are slimmest given that sowp was rejected earlier, is it really the case that my dependents cannot be here at all now?
