Nexus got rejected - 3 year residency not met

Hello All,

My Nexus application got rejected citing that I do not meet 3 years residency requirements. He is my situation :

0. I am an Indian Citizen
1. Stayed in USA from 2013 to 2019 on L1 visa
2. Relocated to India in 2020 and lived until mid 2022
3. Relocated back to USA in mid 2022
4. Received US green card in mid 2023
5. Applied for Nexus in March 2024
6. Nexus application rejected in Jun 2024

Can someone clarify if my stay on L1 visa in USA from year 2013 to 2019 can be counted against the 3 residency requirement. Shall I file for an appeal? Hope someone can help me on this.

This is a forum for Canadian visa questions. This sub-Forum is for residency requirements to maintain Canadian permanent residency. Not for the US and certainly not for Nexus.

You might be lucky and someone might know, but you’d better keep searching the internet for a more appropriate source.

Not sure how the L1 would count towards Canadian residency, but as it's a rolling 5 years, even if it did count, you can only count back to mid 2019. You've missed residency by a significant amount. There's really nothing to appeal.

The requirement is as continuous residency requirement. You broke continuous residency by returning back to India. So assuming you relocated back to the US in 2022, you need to start counting three years from then. So you're looking at sometime in 2025 before you can reapply.

@scylla @Buletruck My wife arrived in US on Feb 6th 2022 and I applied for her Nexus on March 1st 2025 but in between she had gone to India for a couple of months during this period. Her Nexus application was rejected today citing physical presence not being met. I had thought that it was 3 years since she arrived in North America but not physical presence. Can I appeal this or just let it go and reapply in June when she'll be eligible.

I have zero familiarity with the appeal process and can't advise.

So you're going to appeal the 3 year residency requirement when you clearly state she doesn't meet the requirement until June? How does that make any sense?

what you’ve written doesn’t make ANY sense whatsoever
