Hello everyone, looking forward to your valuable suggestion if you know for sure, if you're confused or not sure please pass.
  1. I received an ITA for the Alberta Opportunity Stream (Non-Express Entry) PNP and have already applied for the nomination. After that, I also received an invitation to apply for PR through CEC, and I want to submit my PR application under this. Can I have both a PNP nomination application and a PR application through Express Entry active simultaneously?

  2. On my Express Entry profile, I did not include my wife, but I did include her in my PNP nomination application. if I receive the PNP nomination and apply for PR with my wife later, will that be allowed, considering both PR applications (One EE and another non-EE) might be active at the same time and one will have my wife included while the other one will not have her included.

  3. If I apply for PR under Express Entry without my wife, will she need to leave Canada before or after I apply for PR? If yes, can she come back on her Work Permit later before I get my PR?

You may have to justify how your wife is not accompanying but is currently in Canada.
Would it be easier and hassle-free if she leaves Canada for a year, and once I have my PR, then I apply for her PR?

If I mention that I am sending her backhome because my parents and her parents are old and need someone to take care of them, do you think this will be a good reason to convince IRCC?

If not, what other options do I have?

You can wait and see whether spouse being non-accompanying in Canada becomes an issue or not.

Well, not really. I will apply without her anyway. However, I am assessing the risk factors to take necessary precautions. And I appreciate your assistance. Pleaase, let me know if you have any other ideas or suggestions to make the journey smooth.

In my case I applied with spouse non accompanying, I gave reason as low cut off with spouse so will sponsor spouse after I get PR. Funny thing is on day before my final decision they asked to pay fee for my sposue and approved pr for me and my sposue which I never heared before. So anything can happen. Don't worry applying as spouse non accompanying. It might depends on officer as well.
My sposue was with me in canada during the application.

Wow! Really? In recent times, I have seen people are being questioned for literally everything including why you lived in "X" location if you worked in location "Y", so I am very concerned. Can you share your timeline, was your application recent? And if possible, could you share you LOE stating the reason why wife is not accompanying? I know this can be too much to ask for but it will be a huge help for me. And thanks so much for already sharing your story, it definitely gave me some hopes.

There does seem to be a lot more scrutiny in the past few months so tough to predict based on previous applications. All you can do is wait and see what happens.

I am a Canadian citizen and have been living in India for the past 3 years. My wife got her PR and we both went to Canada in April 2007 and stayed there for around 3 months. We have since then not returned to Canada and are planning to go to Canada sometime in July 2010/August 2010. I have my own company in India working in the video game industry.

  • Will I or my wife face any issues as we have not been in Canada for more than 3 years? Her PR Card expires in April 2012. I have read online that if a PR holder accompanies a spouse who is Canadian, the time spent with the spouse is considered in the total days of PR in Canada. Is this correct or are there some specific rules for this to hold true?
  • We have a kid who is 2.5 years who was born in India and he has a Canadian citizenship certificate. I am looking to apply for his passport from India but am confused regarding the guarantor section? Do I have to get a guarantor from Canada or will any guarantor from India do?
