If someone wants to withdraw a pending work permit application without falling out of status, would a good strategy be to travel out of Canada, and re-enter as a visitor with a valid visitor visa, then withdraw the pending work permit application after re-entered Canada as a Visitor?
The visitor visa was issued according to a post graduate work permit. There was a temporary policy to issue regular visitor visas to foreign workers and international students during the COVID.
According to an immigration lawyer, if a pending work permit is withdrawn while the application being inside of Canada and the original work permit being expired, the application will be falling out of status and the restoration of status and a visitor record application must be submitted.
Therefore, I think it’s better to go out and re-enter as a visitor to avoid the messiness of the status.
