will this be seen as misrepresentation?

Hi Friends, i need you advices.

1, I was rejected a US visa ( B1/B2 ) in year 2004, at that time, my company helped to prepare most the material so i don't have a very strong memory of the process.
2, after that, i gained successfully many visa from many country without failure

3, when i applied open work permit in year 2020, i totally forgot that refusal in 2004, and selected "no" for the question of "ever got visa refusal"

4, now i'm preparing my PR application, when i revisited my previous application, i suddenly realized that i made a mistake last time. I will definitely answer "yes" in my PR application, and will write a letter to explain and confess it is my mistake.

My question is, by doing this, will I still be determined "misrepresentation" and got that 5 year ban?

It's hard to say although probably unlikely. But best answer is that it is probably better for you to admit to it before IRCC finds out, i.e. I think you should disclose when you make your application this time.

Simply include a letter of explanation and apologies.

If you are very concerned, consult a lawyer.

yes, I will definitely to disclose this in the new application.
I'm now in a kind of panic mode, I'm even considering not to make new application to avoid the misrepresentation, because i don't want my daughter faces a 5 year ban because of a stupid mistake made by her farther...

Well, consult a lawyer if you think it will reduce your stress.

But again overall: I think applying and disclosing first is more likley to have good outcomes for you than alternatives. But I can't claim to know.

(Note I'm assuming the original refusal from USA was for some 'normal' reason)

thanks again, I'll consult a lawyer, and although i can't remember the exact reason (only vaguely remember the officer felt i didn't show enough financial evidence), I'm 100% sure it was not because of crime/security or any other "abnormal" reason
