Obese/Rejection/Lawyer

I have browsed profiles of those who got PPR from a Facebook group, and found that none of them were obese. Is there a link between obesity and approval? I know they won't mention that in the rejection, but the visa officer making a decision can make an opinion based on the looks (obese).

I would like to know what you guys think?

Also, are there more chances of getting approval if applied through a Canada-based immigration lawyer? (Not an RCIC consultant, but a JD lawyer)

If it was a refusal based on being obese, it would be a refusal due to failing the medical and you would know based on the refusal letter that failing the medical was the reason for the refusal. Being obese alone would be a reason for failing the medical. There would need to be relatively serious medical issues such as very high blood pressure and potential heart issues, diabetes + potential kidney issues, etc.

Your sample data is so small that it doesn’t even make sense to come with a statement like that.
Now, if the obesity flags somehing on the medical exam thats a complete different story.

You don’t get more ”lucky” if you apply with a lawyer, a Canadian lawyer, a consultant or even by yourself. What they can help you, if you don’t feel comfortable, it’s to fill and catch any errors or typos that you might incur while filling the application.
But even then, people using those services have seen errors in their application.

I have explained in my post that its an opinion based on the weight by the officer, not an official medical issue.

That's why I have posted here, so if anyone obese who got approved can come forward and tell us that hey I am obese and got approved.

How would the Officer know they are obese? The officer does not assess their medical report - this is done by IRCC's appointed physicians, who makes a decision to either pass, request further tests or send PFL. Even if they are involved in assessing the medical results, why would they pass the applicant medically, if their refusal is based on them failing medical test?

I don't see how the weight of an applicant can be taken into consideration by the Officer.

Simple check would be BMI to relate weight and health. But obese is not one of the conditions to fail medical or medical inadmissibility. I know people may speculate potential health issues but they forget that you can lose weight without accessing public resources. Ofcourse, you would want to remain health, but again its not one of those condition to refuse applicant. It is descrimination same as it was for HIV, until when they changed and approved applicant with HIV provided they meet all other requirement

second question: doesnt make any difference, it depends with your profile

HIV+ applicants fell under medical inadmissability when the threshold amount was lower and treatment In Canada was more expensive. Was treated like other medical conditions.

Everyone is misunderstanding what I have tried to ask. Medical will be passed even if someone is obese unless there is an illness which will be burden on the Canadian medical system and would cost over 20k CAD/year or if the illness is infectious like TB.

What I am saying is, medical is passed but VO can still see the medical report, can see picture on the IELTS report, a photograph that one submitted and passport plus any other IDs. This would give VO enough pictures to determine you are overweight/obese. Just like VO go through a social medical profile to get an opinion about you, similarly, they could be making an opinion based on your weight. I hope I am clear now.

It would be discrimination if VO explicitly mentions obesity which he won't. Can refuse on any other ground which would not fall under discrimination.

I would love to be proved wrong if some people come forward and comment that they are overweight/obese and got the visa. Is there any?

I don't understand why you think a VO will refuse someone's visa just for being overweight/obese in terms of looks. I'm pretty sure there are so many other credible factors to refuse a visa like university choice, program choice, study plan, inadmissibility issues etc.

But yes, my friend is like 20kgs overweight for his height but already got the visa and will depart to Canada in a month.

Impossible to make that judgement. Again you need to know the height and weight to make that conclusion, not by the look of your passport sized photograph… May be you are overthinking

bottom line, you cant be refused for being obese.

20 kg is not significant, but I hope you are right. I have yet to see someone who is visibly obese and got approved.
