Hello everyone,

Applied for Refugee in November 2017. Denied Refugee February 2020.

Applied for H&C in March 2020 best interest of children and time spent in Canada, working, family ties etc…

Timeline:
Application received March 27, 2020
Mailed in remaining evidence June 2020
AOR August 4, 2020
Fingerprints & Background Checks (Egypt &USA) October 2020
In process December 15, 2020
Wife and 3 kids( 1 born in Canada) deported back to the USA on March 9, 2021
Husband remains in Canada
NO Medical requested yet

I’m so sorry dear it’s refusal
If it says decision made before Aip usually it’s refusal

Do you think that they could have known about the refusal a while back which would explain the deportation of the wife and 3 kids back in March?

Sorry to hear that. May I ask why you did not consider sponsorship? Is your husband Canadian or PR? We have similar case - I am Canadian but cannot sponsor my partner because he has a 5-year misrepresentation ban from his previous PR application. He almost got deported in May 2021.

he was refused HC twice and only got AIP after we applied third time. So you can keep fighting. If your husband is still in Canada and not Canadian, he can apply HC again. If he is PR/Canadian, you can try sponsorship with humanitarian relief.

There is no indication that the husband is a PR or citizen.
