You need a NOC A, B or 0 role and payslips in order for your spouse to extend their SOWP.
What if I apply for PGWP extension under the public policy, including my spouse, do I still need to have NOC A, B or 0?
You can apply under the public policy as the PGWP holder. Your spouse cannot extend their SOWP without you having a NOC A, B or 0 job.
He does not qualify. You have to meet both conditions (i.e. both #1 and #2). He only meets condition #1. He will not meet condition #2 by the time the policy expires.
He has to hope IRCC extends this policy until summer 2022. That's the only way he would qualify.
You should read all from the top to the end.. You need to apply by July 27, 2021 for this new public policy. His expired daye is October 2022, Until they make changes or extend, he is not eligible
I am sorry guys, I am not trying to argue. I just need to get a consensus.
there is the word OR between points 1 & 2. My friend whose permit will expire in February 2022 told me he was going to extend his permit under this policy but I am really unsure whether he is eligible or not. In the case of my brother, he doesn't have 1-year of experience in NOC 0, A, B therefore not eligible under EE. He told me exactly what my friend is going to do. His choice are:
1. Apply under Canadian international graduates (new pathway to permanent residency). I don't think he will make it due to his IELTS test on July
2. Apply for the PGWP extension

Your brother doesn't qualify for the PGWP extension. Neither does your friend with the Feb 2022 expiry date. Both of them still have valid PGWPs, so they don't meet the first condition. They also don't meet the second condition since their PGWPs expire more than four months after the policy ends. (Unless of course IRCC extends the policy).
1. Try to get an earlier IELTS test date or a CELPIP test date. The new pathway is expected to fill quickly. Lots of people here have managed to find earlier test dates and new slots are opening up from time to time. If this doesn't work, then he will need to wait until he has a year of work experience in Canada in a skilled role to potentially apply under CEC.
2. Not an option.
Its not about reaching to common consensus, its about clarity on the new public policy. He is not eligible given that he holds valid permit expiry in 2022. Deadline for the new Policy is July 27, 2021. Lack 1 year experience doesnt disqualify him in EE, but he will most likely lose points under In-Canada work experience. Your friend assertion is not correct. Your brother ( if its your brother and not you) needs to check his points under CRS and take IELTS test. Unfortunately PGWP is issued only once
Yes they may be eligible under International Graduate stream that has 40,000 cap as long as they meet requirement and provided they started studying not earlier than Jan 2017
