Hello, thank you for your response:

From your indication with Regulations R200(3)(e)(i) :

The unauthorized work was from June 26th 2019 - August 26th 2019. Since then i was on implied status and then on a fully-approved PGWP. So that period of work was well over 6 months ago. Does that make it possible to be ok to apply?

Should i tell a lawyer all this and they can possibly come up with a solution or way forward?
Each case is different and based on facts and circumstances. The forum can only point you to the resources. You should consult a lawyer for precise advised based on your individual facts and circumstances. Also, you can visit a legal clinic to get some preliminary advice for free.

Dear @legalfalcon

i need your help once again.

My boyfriend is a canadian citizen (has not applied for passport yet) but he has citizenship certificate. He lives in Toronto and I am PNP applicant (Alberta). I did not mention my boyfriend's details in EE profile before or after receiving ITA.

As I am a PNP applicant I am little cautious about it. I plan to quarantine at Toronto and then my boyfriend will come with me to Alberta to spend some time. Post that we will be meeting as and when possible.

Can I apply for AL under extended family?
Can my daughter also get AL?
Apart from IMM006 and his citizenship documents, my COPR and visa, do I have to provide anything?

Thank you
IRCC defines immediate family members as:

Definition of immediate family members
The definition of immediate family members set out in the Orders is broader than the definition of family members in subsection 1(3) of the IRPR.

Immediate family members in respect of a person are

  • the spouse or common-law partner
  • the dependent children of the person or of the person’s spouse or common-law partner
  • any dependent children of a dependent child
  • parents or step-parents
  • parents or step-parents of the spouse or common-law partner
  • guardians or tutors
    • Guardians and tutors are individuals who are responsible for caring for a foreign national minor who is living apart from a parent for an extended period of time, for example to attend a secondary school in Canada. The guardian or tutor should be able to demonstrate that they habitually reside at the same address as the minor. Officers should be flexible in accepting documentary evidence.
For additional information related to the interpretation of a dependent child, consult

See https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/service-delivery/coronavirus/travel-restrictions.html#immediate-family-members

However, if you did not mention your 'boyfriend' as a common law partner in your application, then you cannot claim it now.

You will just have to be patient. There are many applications in the same state.
If i applied for EE under CEC simulataneously , will it be faster, or it ends up the same ? I got iTA from EE profile 2 weeks ago. Still pending for more information (82days left)

As per the data available from IRCC, pre COVID CEC applications were processed comparatively faster than FSW and PNP. However, now its all over the place.

How long did it take to process an Express Entry application?
Table 35 displays the time, in months, that IRCC took to process 80% of applications under each program. In 2019, IRCC did not meet the processing standard of finalizing 80% of all applications sourced via Express Entry within six months. The processing time for Express Entry, overall, was eight months. As an alternative measure of processing times, 60% of applications finalized in the 12-month period ending on December 31, 2019, were completed within the six-month service standard.

Table 35: Processing Times for Express Entry applications finalized by year and immigration category, in months

Federal Skilled Worker469
Provincial/Territorial Nominee669

Data is operational and as such should be considered preliminary and subject to change.

  • Processing times refer to the time in which 80% of applications were finalized by IRCC. The processing time is measured from the day a complete application is received until the time a final decision is made by an immigration officer.

I got BOWP approved - start date Feb 05, 2021, end date Feb 05, 2021 (same date).
My representative inquired to IRCC, but the issue is still here. Can I still work for the same employer?

1. PR cards do not have country of birth listed on it.
2. Send a webform and Inform IRCC.
3. YEs, the country of birth would not matter from SIN or other documents.
4. There are no published processing times, and with COVID, even those that are published are not being adhered to.

No need to be hassled by this, this is a minor issue and happens a lot, and will be corrected in due course.
Thanks @legalfalcon

Il send webform/speak to ircc after ive sorted the SIN after quarantine.

Thank you for your guidance.

What did this report conclude?
Can we make a complaint to them regarding the processing delays and there is no transparency in ircc?
Hi. OIC is awaiting the ministers reply to the initial report after which the report will be tabled in the Parliament during the first quarter of 2021-22 (i.e. April - June 2021). The processing delay here is related to access to information requests and yes you can certainly make a complaint

The report has not yet been published and is not public, unless it is tabled in the Parliament. As of now, OIC has now completed its systemic investigation into IRCC’s processing of access requests, including IRCC’s use of time extensions over the past three years. The Commissioner has issued an initial report, with recommendations, to the Minister of Immigration, Refugees and Citizenship. Only after the Minister's reply to the initial report a final report will be finalized, and the special report will be tabled in Parliament before the end of June 2021.

When the report is publishedd it will be available at https://www.oic-ci.gc.ca/en/resources/news-releases

The number of complaints made against IRCC with the Office of the Information Commissioner.

To read on how OIC investigates see https://www.oic-ci.gc.ca/en/how-we-investigate

Some/one person claims that filing complaints does not help much, be careful of such fraudulent claims as all complaints filed with OIC matter and it is because of these complaints, an investigation was initiated and hopefully we will see changes soon. Filing a complaint under the law is your right, and it will be processed in accordance with the procedure under the law.

Also, OIC is not a court or police. The Commissioner provides arms-length oversight of the federal government’s access to information practices, working with institutions to ensure they meet their obligations under the Act. The aim is to resolve complaints to the satisfaction of the complainant.

There seems to be typo in the document issued to you. You should have to rectified before your continue working.

If you don’t have a family name on your passport, travel or identity document, enter all your given name(s) in the surname field and leave the given name field blank. Do not enter “Not applicable,” “*” or “NA.”

See https://www.cic.gc.ca/english/helpcentre/answer.asp?qnum=014&top=4

However, if the form you are filling is not an IRCC one but is by VFS, then contact VFS for instructions.
