Reapplying for TRV for spouse, need advice on what to attach

Hello

I am a Canadian citizen, and my wife is a Russian citizen. We both live together in Russia, and wanted to visit my parents in March for 4 weeks (2 for quarantine, 2 to visit). My wife's TRV was refused for the usual 179(b). The specific reasons were.

based on your family ties in Canada and in your country of residence
based on your current employment situation

We plan on reapplying, but we aren't sure how to address these problems in depth seeing as they were already addressed in our first application.

Family ties: We assume that I am the problem here as I am a Canadian citizen, but I live and work in Russia. We showed proof of my work in Russia by attaching my work contract, and we attached our registrations showing we live together at X address. Other than my parents, who are quite elderly, she has no family in Canada if my parents count as her family. Her parents, sister, and the cat are all in Russia as well, which we did mention in our application. Any suggestions on what else to attach to prove my/her connection to Russia?

Employment: this one really baffled us. She has a very high paying job in Russia, making around 6 times more than the average salary here. We showed her work contract of course, and pay slips a long with a letter from her boss saying it was ok for her to take the 4 weeks off that we asked for. We are not really sure what issue they took with her employment.

As mentioned, we will reapply and hopefully get it this time. We will write a detailed letter explaining why the previous reasons are bunk, but are struggling to find tangible pieces of proof to attach that weren't attached in the original application. Any tips on what more to attach to our application would be greatly appreciated.

Have you ever applied for spousal sponsorship so you can move to Canada permanently? How many visa refusals does she have? Is this her first application?

You are a citizen so it is always met with skepticism that you aren’t trying to move permanently and then apply for inland sponsorship once you arrive. You say you are on contracts. When do the contracts expire or are you permanent employees? If permanent employees show that you are there long term.

You are a citizen so it is always met with skepticism that you aren’t trying to move permanently and then apply for inland sponsorship once you arrive. You say you are on contracts. When do the contracts expire or are you permanent employees? If permanent employees show that you are there long term.
We applied for outland PR back in July, and provided our receipt, temporary number, letter explaining that we would not risk losing the PR by her overstaying a short trip to visit my parents, etc.
This is her second application, first one is from 2 years ago. It was also rejected, but simply for "purpose of visit". We wanted to attend my friends wedding together, but I had to go alone.

My contract is permanent and shows the date it was signed by me and my boss, hers expires in December 2021.

So you have a spousal sponsorship application underway...that is most likely the issue. With spousal sponsorship, you need to show proof you are going to move to Canada. Officers know the plan is to move permanently even if you are showing proof that you will return to Russia. If you applied in July, why not just wait for approval.

She may be given a 6 month stay when entering or could file for an extension while in Canada so the not overstaying to risk her PR application isn't a valid argument

It’s definitely a huge catch-22. Can’t come in without a PR because you’ll just apply inland and stay, can’t come in with an outland PR because you’ll just extend your TRV and stay until it’s finished.

I suppose there’s no possible way to prove that we wouldn’t do that, if our work contracts and apartment weren’t enough I guess nothing will be.

It’s a shame Canada is so extremely unfriendly to foreign spouses in this regard. So much for valuing family and reunification

It’s definitely a huge catch-22. Can’t come in without a PR because you’ll just apply inland and stay, can’t come in with an outland PR because you’ll just extend your TRV and stay until it’s finished.

I suppose there’s no possible way to prove that we wouldn’t do that, if our work contracts and apartment weren’t enough I guess nothing will be.

It’s a shame Canada is so extremely unfriendly to foreign spouses in this regard. So much for valuing family and reunification
I'm not sure if it will help but you can send in proof that she is supporting her family in Russia? That ties her to her home country. Get letters from family detailing financial support from your wife, get receipts if necessary. I did this for my TRV application. My husband is Canadian and I'm living in Singapore, applied for a TRV on the 29th November, got approved today.

You are applying for sponsorship so clearly have intentions of relocating. If you had not applied for sponsorship you may have had better chances.

Her TRV application from a couple years ago, before she applied for PR, was also refused but for “purpose of visit” rather than “family ties” and “employment” despite the only significant change in the application being the purpose of visit (friend’s wedding vs visiting my parents). It seems like it likely wouldn’t have mattered what we did. Family ties and her job (the exact same one she has now, same contract and everything) weren’t a problem then, but they were this time.

I'm not sure if it will help but you can send in proof that she is supporting her family in Russia? That ties her to her home country. Unfortunately for us, she doesn’t financially support any family members. Tying her to Russia is her job, me and my job, our apartment, and the cat. These apparently aren’t a strong enough connection
Blame it on many others who never returned.

Hello everyone , am sorry for writing herer as am new to this forum , am note sure how to write a new thread , I need help please , basically I applied for a vistor visa as my husband is Canadian , and I got a refusal stating these reasons :

• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your family ties in Canada and in your country of residence.

• Your husband should submit a sponsorship application for you.

So now we are planning to apply for the sponsorship first then re-apply for the visitor visa again but as for the first 2 reasons , am just wondering how respond to them knowing that Im working a part time job and am the only one living with my parents.

The biggest issue is you are married to a Canadian and to get a visitor visa you need to show that you are coming for a visit. VOs believe you will not leave Canada. You need to show:

- Ties to home country: job letter with leave allowed, property, investments, loans
- Travel history: travel to UK, US, AUS, NZ
- Funds: travel to support your visit

You may have to wait for sponsorship and then move to Canada permanently.

I see thank you so much , If I provide my job contract without the leave allowed , wouldn' that be enough? unfortantly I dont have any property nor investements nor loans , I have lived in the UK for 2 years and I had my daughter in there but that was back in 2014 would that also be helpful?

So you are leaving your daughter in your home country? You said living with parents, not daughter.

You need to show employment letter that allows you to visit.

Yes am living with my daughter and my parents , am planning to use my job as a home tie but am not sure what I need to provide as documents?
