Hello all I am hoping to get some help with this. I applied for a 1 year extension in Jan 2020. I was approved recently but only until September 2020. Is this an error or does this happen? Do they explain why they reduced the time if it was not a mistake? I know it is very hard to get a hold of them to find out if there was an error. Just wondering what I can do. Thank you! -t

1. No, it is not a mistake. CIC felt that a 9 month extension was sufficient. If you want to know the reason, order the GCMS notes.

I guess the only option is to apply for another extension? I am not looking forward to traveling with Covid going on.

Where are you from? Are flights halted to your country right now? Who are you visiting in Canada?

Best option would be to return home in September as request rather than applying for another extension.

I'm from the U.S. Visiting my girlfriend. We have been together 4 years. We have been trying to create common law (a complete full 1 year) so that I can apply for PR ,but there always seems to be some hiccup. It almost worked out last year but the paperwork was delayed/lost (not my fault, they even annotated in my file the problem they had that year). I was hoping this year would be IT but doesn't look like it with the reduced time frame given and Covid issues. Hopefully the border opens back up (if safe) otherwise we will be another one those other sad couples unable to see each other. Not sure what else to do, might try to get an immigration lawyer to help us.

Have you already submitted the common law application? Did you apply inland and include an OWP application?

It states that you have to be living with a person for 12 continuous months to be considered common law. I figured the extension is the only way to achieve this but we have been unable to make it 12 continuous months with all the paper work hiccups etc. Are you able to apply for common law before that somehow? Thank you for your time -t

No - you cannot apply as common law before you hit 12 months of cohabiation. Applying early guaranteeds refusal.

Will you hit 12 months before September?

I just got approved for TRV that only gives me 3 months of status here. Would the months before actually count? I know for the PR they want a lot of proof together like leases signed together, bank things together etc. You can't do that while just a visitor so how would that work? Maybe I have been misinformed? Let me know, thank you!

The months before will count provided you have evidence to prove you were living together during that period.

You can certainly get a joint bank account while here as a visitor. Same goes to getting your name added to the lease. Both are totally feasible and more.

To be successful with a common law application, you need hard proof you have cohabiated for at least one full year. That proof has to date back at least a year from the time you apply as common law to prove you have the full year of living together. In other words, you can't get the joint bank account and joint lease now and then immediately apply for common law.

Just got misinformation I guess. Her landlords wanted proof that I would be here for a year before doing a new lease, I couldn't provide that without the trv approval document. I guess they could back date the lease but doubt they would do that. The bank had a similar response stating they needed documentation like an approval letter. From there I just figured everything was needed with the approval letter but they never came in time or with enough time. The only other step is to just get married but from what I've researched it doesn't help a whole lot when trying to get this all going.

Getting married would change everything. I don't know why you think that wouldn't help.

If you are married, then you can apply as such as there is no need to prove you are common law.

I guess we just need to go that route. We have been trying to do everything by the book and being honest but unfortunately there have been to many hiccups with the common law thing. We will still probably get an immigration lawyer just so we dont hit anymore snags. Thank you for your time and input. -t
