Helping as a friend, i have friend he is pakistani, he came here in canada as spousal visa since 2017, then the marriage isn’t working with them, i think because of the circumstances, the guy working as a truck driver bounding Canada-USA, they can meet wife only twice a month or 3 times a month depending on his schedule, so now the wife, i think Isn’t happy anymore of this kind of relationship because are longdistance sometimes. The wife decided to Deport him and report to local authorities, even i think the CIC call centre she report him, then she mentioned them his husband as terrorist as well. And The guy he is depressed and stressed sometimes because of that happened is there any chances he can deport him by wife reported. Then now i heard of him, he involved pornography offences last year 2020 because of his friend from pakistan, sending a little guy dancing with naked maybe the little guy is around (7-10 ages) he show me the police clearance attached the offences there is “pornography offence” The border got his phone and checking all this information etc. And luckily the officer got attention of that naked little guy sending his friend from whatsapp. Is there any possibilitties the authorities forced him to leave the country because he is my friend. One thing he hired a lawyer as well to defence him but the lawyer always saying to him no worries i will take care of that. He pay much money until now but the cases still not yet resolved. Is there any chances can revoked his Permanent Resident as well, even the Elimanation of the PR is repeal already by sponsoring of wife. Your comments and suggestions it well be help for him..

This situation is too complex for this forum. He needs professional adivce and to be working with an excellent immigration lawyer.

Slightly disturbing that child pornography is being talked about as no big deal. His lawyers will need to take into account that he could lose his status based on his criminal case. His employment could also be at risk as well. Far too complicated for a forum.

He needs to be speaking to a lawyer. If he is convicted he may not be able to travel to the US. The wife can’t get him deported unless she has a lot of proof that it was a marriage of convenience and then it will be up to Canada to decide whether he gets to keep is PR. The outcome of his case will be what decides whether he keeps his PR or gets removed. His lawyer needs to be aware of his immigration status and it’s importance when decision on what strategy they should take to fight his charges or settle the case.

As others have said, your friend needs a competent criminal lawyers who can defend him. He may need to re-assess the present legal team competency. Because once his current status expires, your friend will find it difficult to renew or get any immigration papers. As per job, due to the pending criminal charges, your friend can only work in few jobs that doesn't involve direct contact with children or vulnerable people including people with disability and sensitive jobs. He must also avoid any serious driving offences that may involve the police.

The terrorist claim is not an issue. He likely wouldn’t be able to enter the US If there were actual concerns he was a terrorist. Have feeling your friend is downplaying the extent of child porn he was caught with or how bad the images were.

The allegation of terrorist by wife will still need to be proved and investigated before he can be charged. Regardless, I will suggest he contact the wife and promise to look for job that are close to her. He can still drive truck that won't involve international boundary or long distance haulage. He can also seek advice from family law firm or free legal advice from legal clinic or pro bono service. Staying away from him won't help, except if you consider your friend too dangerous and lacked essential change mechanism.

Pretty sure that it sounds like the marriage is over so there wouldn’t be a need to be at home more at this point. Long haul drivers are much more in demand so getting a decent paying local driving job may be difficult. Given his income he likely doesn’t qualify for a free legal clinic but he can certainly try. Child porn cases aren’t things that firms tend to take on pro bono.

I agree with you. But, if the issue of "child pornography" was true as narrated. The accused still has burden of proof to demonstrate that the picture in question wasn't originated from him or have interest or engage in such punishable offence now or before.

I guarantee with you that he probably had tons of child porn. The situation was likely downplayed by his friend.

Im not sure because thats the only he saw me the video a little guy dancing with naked then i ask him do you have more video then he said no more... he still keep on his album i told him please deleted with that because its against the law, is violence, he say that he doesn’t know about that cases because in his thinking, is for fun because the guy dancing. Then i told him even though the guy dancing naked is below 18, you dont have right to keep that kind of video. Then after that he deleted.. but he is already committed in this situation, the border figure out to him thats why he charges him...

If it is just a little child dancing I don’t think he would be charged.
