Hello,

I recently moved to Canada on Work Permit (Intra Company Transfer). I have the following documents with me (shared by my employer):

1. Offer of Employment (on attorney's letter head)
2. Roles and responsibilities (on my employer's letter head)
3. Annual compensation and hours of work per week and per month ((on my employer's letter head)

My Question: With above documents will i be able to claim that i have the job offer and get additional 50 points.

PS:
1. I have taken IELTS (have a good score)
2. Educational assessment completed.
3. I am falling short of 20 odd points for ITA in express entry pool. These additional points will help close the gap.

This is my first post. Thanks very much for your advise and support

You will only be able to claim the 50 points once you have worked for your employer for a full year in Canada.

To be able to claim the 50 points now, you would need to have an approved LMIA from your employer.

Thanks Sylla for your reply.

My employer applied my work permit with LMIA exempt No. So after one year i will still have the same LMIA exempt offer of employment, hence wont be able to claim any points for job offer.

I know i will get experience of 1 year and that too carries additional points. But i was hoping to not wait for another year and get it done soon.

When i read online, i see a valid Job offer as the required document. It does not mention that i need 1 year on WP-ICT to be able to apply in Express Entry with Job Offer.

It may be my ignorance speaking, apologies for that. But your help is highly appreciated.

Thanks!!

This is an extremely common question that has been answered on this forum repeatedly. Since you are on an ICT and no LMIA was required, you can only claim the 50 points once you have worked for your employer in Canada for a full year. Once you reach that full year, you can claim the 50 points without an LMIA.

This requirement is clearly outlined here:

A valid job offer has to be:

  • made by one employer
  • continuous
  • paid
  • full-time (at least 30 hours a week)
  • for at least one year after we issue your permanent resident visa
    • not seasonal
    • not on a contract basis
  • in a job that is NOC:
    • Skill Type 0 or
    • Skill Levels A or B
It also must be made :

  • by an employer with a new positive LMIA that approves the offer and names you and your position OR
  • if you’re currently working in Canada in a NOC 0, A or B job on a work permit that was issued based on an LMIA, and:
    • you’re working for an employer listed on your work permit
    • you’re authorized to work in Canada on the day you apply for a permanent resident visa, and when the visa is issued
    • your current employer made you an offer to give you a full-time job for at least one year if you’re accepted as a permanent resident OR
  • if you have a valid work permit for a NOC 0, A or B job that is exempt from needing an LMIA, and you:
    • are currently working for an employer specified on the work permit
    • have one year of full-time work experience (or an equal amount of part-time work) for that employer
    • have a valid job offer from that employer for at least one year after we issue your permanent resident visa

When we choose offer letter, is mandatory to have valid work permit for another year.
I have completed an year in Canada and ready to create profile with all other formalities done. However I have my work permit left for another 6 months. Someone told me that I'll have to wait until my permit is extended after another 6-7 months so I have work permit for at-least an year.
Please comment if someone knows about it.

Hello All,

I have a valid job offer from Canadian employer. I have received 50 points for that but my lawyer said it is only valid for 6 months. If I work with the same employer for full 1 year, will I get that 50 points back ? Also after 1 year if I apply for LMIA again for the same employer will I get 50 points more? So all total is there any possibilities to earn 100 points? Please advise. Thank you.

No - you won't get an additional 50 points. You can only claim the 50 points once.

The 50 points I will get after a year has any time limits? Like 50 points for Job offer is valid for 6 months.
As long as your employer clearly states in your job offer that they will support you post PR for at least one year of employment.. you can still gain 50 points.

My one year gets completed on July 23 2019, my assignment letter is till 31 July 2020, and the probability of draw happening is 18 July 2019, so while submitting the profile where it asks that have you completed one year in the current job, can I say yes or I have to wait till July 23rd 2019.

It is requested to kindly reply as my case is neck to neck on the basis of dates

Hi....I wanted to know if you have already got the PR? How did your final decision from irCC turn out with regards to that “Arranged Employment 50 points (valid job offer)”. I am in the exact same boat, I’m getting paranoid...I have also claimed 50 points for arranged employment, by answering “yes” to the valid job offer question. I completed more than one of year of employment in canada with the same employer (ICT). 5 months into PR processing, awaiting decision (Medical and criminality passed). Please respond!!

My application was refused after 8 months of applying. The letter of refusal said that my offer letter did not state “confirmed employment for 1 year after getting PR”...hence my application got refused. I am now going to apply PNP and then reapply.

For the 2nd bullet point, does the one year full time experience for the employer has to be in Canada? I have been working for the employer for many years and I recently moved to Canada on ICT visa for the same employer.

Thanks.
