Hello Legalfalcon,

I need your advice. My existing medical results are valid for only 5 months from now. Shall I submit my PR application ? or Do I need to go with new Medical exam. I am staying here in Canada. could you please advice.

I received 2 ghost updates on 11th and 12th September 2019.
In my quest to understand what the updates meant, I send a mail to MP Goodale’s office, but I got a reply that the status remain unchanged as eligibility still requires review.

Is this normal?

I am not clear about what this note mean? What is the ‘ATIP RELEASE ACT 16(1)’? Because I could not found the information in Google about the law. Or is it just to show a verification result that the certification is genuine?



I am worried about that because in the last application, I asked my family who are in the home country to help me handle the certification of deposit and she did not know much about that. The certification of deposit is the last file I got, so I immediately submitted the study permit application as soon as I got the certification. The question is the day the bank issued me the certification is quite close to the day I submitted the study permit application(nearly the same day), which I think may be a problem, but I am not sure about that. Because some of my friends also did that, but they got approval..





Please could you help me to figure it out. Thank you so much !

The ghost updates signify a movement in your application, what exactly is unknown and can only be found by going over your GCMS notes and mating the corresponding dates on which you received the ghost updates with any notes or activities in your GCMS.

Understanding “Review Required”

A lot of applicants see “review required” in their GCMS notes for eligibility. There are many theories floating around with regard to what “review required” means and if it is alarming.

Before I venture into explaining the significance, it is important to understand that each application goes through the following stages as per the Immigration and Refugee Protection Act and the regulations (Canadian Immigration Law):

R10 – Completeness Check
Criminality
Medicals
A11.2 – eligibility
Security

Out of the above, the most important stage is eligibility. This is also the most time-consuming stage because your documents have to be verified, evaluated and assessed to ascertain that you meet the eligibility criteria for the program you have applied (FSW / CEC / FTW). To stream line this process and make it easier for an immigration officer (decision making authority), all applications are first evaluated by case analysts or program assistants. They review the documents and summarize it in the GCMS. If they have any concerns with any document or want the immigration officer to carefully look into a specific document, they will flag it as “review required.” It is the content of the note that is important here. If the review required is for a specific document, while the summary of the note says that an applicant has met the eligibility, or “ready to finalize” it simply means that while the applicant has met the eligibility criteria, but the specific document needs a careful examination form the officer before promoting (eligibility pass) by the officer.

However, if there are concerns, there will be a review required for the eligibility, and there will be no text to the effect “ready to finalize” or pass. The note will specifically state job duties do not match, or the employment cannot be verified, or the number of years of work experience claimed cannot be verified. This is where an application can land in muddy waters. But the final decision rests on the immigration officer. He may override the decision of the analyst / assistant or go with the analysis of the analyst / assistant.

Even in cases where the analyst / assistant is of the opinion that the applicant has met the eligibility, and there is no “review required,” the officer can replace it with his own opinion. Though rare, but it does happen. This is why the eligibility is only passed when an officer conclusively marks the eligibility as passed.

Finally, there is “review required” for PoF. This is the most common in many applications. This is because, the financial and banking practices of each country are different. Eg. Fixed deposits are know as Certificate of Deposit (CD) in the US. Similarly, treasury bonds, mutual funds, stocks, and many other investment vehicles are there. If your PoF anything other than a bank deposit, it is more likely that it will be marked as “review required.” Also, IRCC does not go by day to day fluctuations in FOREX. Instead, the Canadian federal government issued a quarterly conversion rate for all FOREX vis-a-via CAD. If your PoF is in a foreign currency, then you may have “review required” for the officer to make a determination.

Just because you have “review required” does not mean that you hit the panic mode. Instead, read the context in which it is there. If there is a concern regarding a document, you can send a replacement document via CSE. The most common reasons for RR are:

1. Work reference letter without job duties
2. Work reference letters missing all the details requested by IRCC
3. If you submitted a letter from a colleague because you were unable to get one from your employer, but did not have a LoE on file, this too will lead to RR.
4. Not sufficient work experience in the primary NOC.
5. Inability to verify your employment as your employer details are missing.

There are just some of the scenarios.

You can submit your PR application. However, most likely IRCC will ask you for a new meds before your application is approved, or they may just extend it.

But you can sure submit your Application.

What does the CSIS notes exactly state. I doubt it can be that it is cancelled. It can either be that they have no record, or it is still pending.

I have a very strange situation. My AOR is 3 September, and I submitted my study permit on 15 September which got refused on 25 September.

My question is- should I raise a webform and update IRCC? I wonder if this will come under "previous visa refusals" because I submitted my study permit application after AOR. Please help!

Anything post AOR need not be disclosed. Also, your study visa application will be accessible to IRCC. But you can send a webform and inform them of the refusal, either way it won't matter much .

During one of my visit, although the immigration officer stamped my entry on my passport in the airport but somehow he missed to enter that in the Computer records.

I came to know about it during my visit to Thailand where i have to wait 1 hour before the officer let me go.

In this situation, is there anything I can do to avoid any risk? I even don't know which entry was not recorded so i am clueless what to do. Even if I write LOE, what should i write cause i have no clue which airport or which entry was missed by the officer :(

Who missed, which country, what is your country of issuance of your passport. I cannot answer abstract questions.

Hi @legalfalcon and everyone here. I have two queries, which I hope you can help me with:

1) I applied with my common law partner and our 2 kids for PR this January 2019 and we are still waiting for our passport request. This month, my partner and I got married. We currently have not received our marriage certificate from the government yet so I have not informed IRCC of the marriage because I have no document to upload to support the change in civil status. In case we receive our ppr prior to receiving the marriage certificate, can we submit our passports already and then later just raise a webform to inform IRCC of the marriage when the marriage certificate becomes available? Would this create any problem with our application?

2) My passport is expiring in May 2020. Should I wait for ppr before renewing my passport or can I renew it now and send the new passport to VFS once I receive ppr? In any case, do I need to inform IRCC of the passport renewal?

1. No, if your family composition changes, i.e. you have changed from common law to a marriage, you will have to inform IRCC. However, this won't affect or delay the processing as they already have processed your application for both you and your partner. However, you will have to update your relationship.

2. You can renew your passport if allowed by your country. You do not have to wait. If your PP is expiring soon, it is advisable that you renew it ASAP as you will get a visa in your new passport, so you won't have to carry two. Also, you will save on time later renew the PP when you land in Canada.

Also, Your PR visa cannot be issued for a duration longer than the validity of your PP.

After you renew your PP, send a scan of your new PP to IRCC via CSE (webform).

Dear legalfalcon sir, thanks for your guidance and support. I have one silly question, although I have done proper research on this topic and gone through various posts by experts. I need your opinion regarding the docs I have submitted for divorce.
1. Original divorce certificate(hindi)
2.translated copy in English duly notarized and valid outside india stamp
3.translator letter mentioning that he has translated hindi to English translation. Notarized and valid outside india stamp.
4. One copy of original with true copy stamp and translator stamp and notarized with valid outside india stamp.
5 original invoice of translation.

In india to become a translator no licence is required, my translator is listed on MCA (some govt site), he does translation for embassy's, he has GST number and a website.
Are these documents complete or did I missed anything.

I am also counting days to get gcms notes. I have applied 9 days back.

There is no need for a translator to be certified. However, it is advisable to go through one. When submitting a translation you need the following documents:

1. Scanned copy of the original document (color)
2. English / French translation
3. Affidavit of the translator that it was translated by them
4. A certified copy of the original document.

If you have all of the above, you are good.

You can travel anywhere. There is no restriction on your travel after your receive COPR.

if someone could help please.
I have work reference letter of 4 years, which was issued to me on 2nd april 2017. The company has closed its operations now and it no longer exists om ground. And that time owner is also ready to give me an declaration from his side on revenue stamps and notorised that i had worked there for 4 years and was paid in cash..i dont have any tax returns. I was sales supervisor.
I can also manage another employee's reference letter who is also having a experience letter from the company as technical supervisor.
There is also a letter by govt authority that firm is not allowed to continue its operations due to some rules.
Will these will be enough ? Or there could be some refusal?

what I mean by "missed to enter that in the Computer records" is that when I landed from a visiting country to my own country, the immigration officer who puts arrival seal on our passport and enter the date in his computer, he did the stamping but didnt put the entry in his system. So, in this case, is there anything I can do to avoid any ADR or risk?

My second question which i guess you missed out to answer in the amidst of so many questions is that, my offer letter, appointment letter and promotion letter is on the letter head pad which had my companys previous address on them. However now my office has relocated to a new address and my reference letter and release letter has this address on the letterhead. In this situation, should I describe the different address situation through LOE? or it is a common phenomenon and I dont need to write any LOE in this condition? pls advice sir.
