Visitor overstay or not returend

I invited my step father to Canada with my mom - my mom died due to breast cancer and my step father did not returned -

I want to know if I can invite my uncle now or no - is officer going to refuse my uncle visa because of that or its not considered .

if anyone know please share your thoughts so I can arrange invitation letter for my uncle.

So your stepfather is still in Canada? He can’t just remain here forever with no status. Yes you could have difficulty in the future inviting anyone else. The other issue could be whether you have unpaid medical debt if your mother remained in Canada to receive treatment for her breast cancer.

He applied for PR and got his paper approved-

I am just wondering if officer will really take this series because my mom came and went back its when the second time she came to visit me her health issues get worst and she passed away here .

I really need some advice what step i should take

This is very confusing. It says visitor overstayed as your title. Did your mother and stepfather both overstay visas? How long? Did he apply for PR via H&C? Do you have outstanding medical bills in Canada at the moment?

My mom died after 25 days she did not over stay she was on supervisa

Yes i do have medical bill from hospital still paying

You can invite your uncle. It's fine.

I have - support letter from grave yard saying the will install headstone on XXXX day.
I also have support letter from MP
My bank statement -my NOA
And other require documents
I have strong documents from my uncle which prove his ties to backhome
Also his job letter from Russia

The only thing makes me worries my step dad claim refugee but he have no contact with me now since my mom passed away,

I have all documents to support the application but still not sure how it will go-

Loweyer told me it doesn't matter they look more on applicant so lets hope they approve -

Applying next week any idea or advice will help - thank you everyone for your time and advice.

You hadn’t mentioned that your stepfather applied for asylum. Yes that will create problem for your uncle. There will be concerns he will claim asylum s well. You should definitely try but there are red flags with his application.

OMG ): I don't know what to do now

Lawyer told me it doesn't matter- not sure what to do now I went through very bad time I can get my friend send invitation but I don't want to do something fake, because I need him to come and its the only 3 months he can come because he is going back to his work in Russia ,

Should I explain all these in my application or no?

There is no legal relationship between the step father and the uncle, so it should not be an issue at all for the uncle's app.

Just invite him. Don't have your friend send the invitation. You do not need to mention or explain anything about your step-father.

The fact that she sponsored the mother and stepfather via supervisa and he claimed asylum would easily be able to be seen based on her previous records. Given that the uncle is from a high risk country for asylum seekers there will already concerns about him seeking asylum. His application isn’t very strong without the stepfather applying for asylum. Not saying he shouldn’t apply but...

I agree dear,
I know my country rating is not so good but just because he is working in Russia and he still have valid visa and paper work from the company he work - he will never stay in Canada more than a month- but for me I will try if he get it will be great so I can show him best places and also we can do the prayers and headstone installation together.

I totally understand that its not easy to get Canada visit visa- that's way I need some good advice from good people like you,

you know lawyers and immigration consultant just worry about money so they wont tell me all the negative and positive possibilities.
