Study Permit approved and SOpen Work Permit Refused

Hello Guys

My partner and I, we both applied at the end of July. He is going to start his master in Canada this September. Unfortunately the things didn't go as we planned. The embassy approved his study permit but refused my work permit. My intention is to travel to Canada with him and support emotionally and perhaps economically (if I find a Job there). He has a full scholarship granted by the Colombian Government. And it's mandatory we come back to Colombia after he finishes his studies due to if we don't, we have to pay for everything, its kind of forgivable credit.

The embassy said that the reasons were because of my family ties in Canada or home country and also about the purpose of my visit. I don't really know why they refused my SOWP. My profile is strong enough to ensure I'm not gonna stay in Canada after all.

We both own 3 properties in our home country, I have a car and also my business company with 3 active employees. I do have a very good income, and my travel history is good. American Visa, The UK visa (expired), a Japanese visa, a Cambodian visa, Thai Visa, Indian Visa, a UAE visa. and I have also traveled to Russia, Ecuador, Peru, Bolivia, and Panama.

My family in my country they are economically stable, my mother has a very good income, she is 62 and lot of properties in the country, my two sisters are independent and both married. One of them has 2 sons very young in the school. their husbands have been working in banks for ages.

I don't know how to reapply, I would really appreciate if you help us.

Spouses aren't guaranteed OWP.

Many students sponsored by their countries end up staying in Canada and pay out the cost. Given that you have a business in your home country it would be strange that you could leave for that period of time and if you could leave for so long it wouldn't be considered a strong tie. Do you have the personal savings to support you and your husband's living expenses if you can't work? Travel to the countries listed don't really count because it is easy to obtain visas to those countries.

As others have said. Spouses of internation students aren't guaranteed a visa/permit. Do you have a TRV?

Well, our government will give us a monthly payment for expenses in Canada around 2300 CAD per month for max 2 years and the university also offered to my husband a place to work in campus. We do have savings in our account for around 15.000 CAD and all the university fees are also covered. You said that the countries listed don’t really count but the USA visa I think it does. I have visited USA twice and I live in the UK for 6 months as student. I don’t have TRV, do you think I should apply for it first or perhaps find another way to be there, actually I just want to be there with him. Incomes don’t really matter. To have a work permit would be fantastic but the main idea it’s to be together.

Didn’t see where you mentioned US visa and whether you actually visited the US. If visits are for work they usually don’t count as well. TRV is more likely to be refused versus a SOWP because you are not looking to be a temporary visitor. It will be pretty clear that you will want to stay with your husband for the duration of his studies. The fact that you only have 15K of savings is the biggest issue. That isn’t sufficient to support 2 people for the duration of his studies. Did you include the monthly stipend from Colombia? The refusal may be due to previous Colombian students not returning to Columbia after their studies. Would also encourage you to order the CAIPS notes. They may give you more information on why you were refused. In cases of spouses of international students, Canada never guaranteed that you would get a permit so it is up to them. I have a feeling that you are looking to immigrate. You would qualify at the PGWP stage if your husband can find a job in NOC 0, A or B and has 3 pay stubs.
