Seeking Asylum (Refugee)

good day everyone
I wanted to be sure before making a move.
Im Bose, I'm from Nigeria living in USA, i’m thinking of going to Canada as a refugee, I don't have a visa to live here in Usa cos mine expired, and have been going through some life threatening stuff by my ex husband also i can't return back to Nigeria due troubles from family that can take life, I'm divorced with a baby and also pregnant at the moment. Things have been really bad & complicated.
My younger sister is also going with me she 18yrs and she is an HIV patient from birth but she is healthy as she takes her medications everyday & her HIV is undetectable.
I really want to leave USA to start afresh, I'm not completely poor nor rich but security and moving is my major concern and being illegal in USA in a time like president trump is also scary!

So I'm planning on trying this Canada asylum but I'm also worried.
*Why do people get deny? I read some people were denied.
*Can my sisters medical condition affect she is (HIV) can that cos a denial?
*Will we be held and arrested at the border?
*Must we stay in the camp?
*How long will we wait to get a permanent resident If everything goes well with a good lawyer?
*Must I have a visa in Usa before I can seek an asylum?
I have so many questions but I need to leave Usa immediate please an urgent response will be appreciated

Getting asylum is Canada is not an easy process. Problems with your husband are not valid reason to move from the US to Canada. It sounds like you and your sister have been in the US for many years. If that is the case it will make it much harder to claim asylum. Issues with family are often not reasons for claiming asylum. You must show that you and your sister were persecuted. You mist show that you exhausted the options in your own country like moving to another region of the country. Many are refused because they had not sought safety in another part of their country before claiming asylum in Canada. If you do qualify for asylum it would take approximately a 5 years to get permanent residency. You sister has to prove that her life was also in danger as a separate case. I would consult with a few Canadian immigration lawyers about your chances of success before making such a drastic move.

Yes you could end up in immigration detention. Depends on the case.

There is no camps. You could end up in a shelter for Canadian homeless people.

Also immigration detention why? And what case will land me in immigration detention?

I was planning on coming by road through the border, will I be landed in immigration detention for this?

Your sister will need to have her own asylum case and reason for asylum she is an adult.

In order to enter Canada you will either need a visa or a family member in Canada. Sorry I thought you were asking about a Canadian visa and not a USvisa. Immigration agents determines who ends up in immigration detention. I don't know who decides who goes and a how long people spend there. If you have your own money for a hotel or apartment you can stay wherever you want. Getting an apartment without a job may be very challenging. The costs of living is higher than many regions than in US and vacancy rates are very low. Finding an affordable apartment can be very difficult. Many asylum seekers are becoming homeless. You will also have to budget for furniture, kitchen supplies, bedding, etc. I don't think you realize how difficult claiming asylum can get and how many people from Nigeria are being refused and will end up being deported. Having a child in Canada does not guarantee that you can stay in Canada. Option to relocate within your own country gets asylum cases refused all the time even in cases when the refugee "judge" agrees their life is in danger.

Please bear in mind that currently Nigerian nationals have 29.68% approval rate based on IRB website, you could ended up by deporting back to Nigeria if you fail to prove that your life is in danger. Family matters are not considered as serious persecution to get accepted.
You need to have evidences that proves your life is in danger.

If she is currently in the United States wouldn't she need to claim asylum there first? Or seek help of American police/govt if her life is at threat?

You have to have strong proof that your life is at risk. You have to show that you have tried to seek protection in your home country by contacting the police, relocating to another part of the country, etc. Unless you have a good reason to extend your visitor visa extensions are unlikely to be approved. You are also not allowed to work with a visitor visa.

You have to show that you have tried to seek protection in your home country by contacting the police, relocating to another part of the country, etc. Unless you have a good reason to extend your visitor visa extensions are unlikely to be approved. You are also not allowed to work with a visitor visa.
