Hi @legalfalcon

I have been a silent follower of this thread and i feel like i am the only person left from the july2017 aor group who is still waiting for PPR. My husband who is a police officer is under comprehensive security screening since april,2018. I just want to ask up to when should i wait before taking any legal action? Because, honestly, i am already tired of waiting. I have ordered several notes (GCMS and CBSA) but this SS is taking forever to process.

Eligibility: passed
Criminality: Passed
Medical: Passed, expired
Security: In progress

Good day@Legalfalcon.....my PoF is currently held in a fixed deposit account.I want to know how many days/weeks/months it takes to “investigate” whether an applicant has the right amount of PoF?Please your candid advice on this point is needed.Thanks!

1. You should always use the name as it appears in the passport. A missing middle name does not need same name affidavit.

2. Country of residence will be Scotland.

3. The date you graduated, or finished all formalities or when the session ended, need not be the same as your degree date or when the results were announced.

6. The personal history should be a combination of work, education, and travel.

7. IRCC can ask additional documents. It veries on case by case basis.

Just one doubt.

1. whose passport? Mine or my dad's? coz my dad doesn't have a passport yet but his other documents have official name as X Kumar Y, whereas my passport has Father's name as XY.
So, if middle name doesn't matter that much, can I put his name in family details as XY or should I go with X Kumar Y?

Also, you seem to have missed out this point in the list of questions I asked, any idea on this as well?
The gift deed is notarized (INR 100 stamp paper) with the signature of the donor (my father) and the donee (me) and one witness (my mother). Does this gift deed need to be registered in India?

In most cases security takes 3-15 weeks. You are well within the time frame, so no need to worry. The security is done by different agencies, CBSA, CSIS, Ministry of Public Safety, RCMP, among others.

After the report from all of them is received, IRCC will update your file.

This is the general path during the security stage.

Your eligibility has not yet been passed by an officer. The notes you see are a recommendation by an analyst or assistant.

After the recommendation, the officer will review and make a final determination. As soon as your eligibility is passed by the officer, the security will start.

1. Why such a delay when the agent has raised no doubts? People from my city with December AORs have already got PPR! :(
2. Should I order another set of GCMS notes?
3. My spouse has quit his job. Should we inform CIC? (no CRS points claimed)

1- Every application has a different processing time because every application has a different history. Don't worry the delay can be because of high workload

3- It is advised that any changes after you have submitted the application should be reported. If your eligibility would have been clear, then you should have avoided it, but i suggest you to report it.

A lot of applicants see “review required” in their GCMS notes for eligibility. There are many theories floating around with regard to what “review required” means and if it is alarming.

Before I venture into explaining the significance, it is important to understand that each application goes through the following stages as per the Immigration and Refugee Protection Act and the regulations (Canadian Immigration Law):

R10 – Completeness Check
Criminality
Medicals
A11.2 – eligibility
Security

Out of the above, the most important stage is eligibility. This is also the most time-consuming stage because your documents have to be verified, evaluated and assessed to ascertain that you meet the eligibility criteria for the program you have applied (FSW / CEC / FTW). To stream line this process and make it easier for an immigration officer (decision making authority), all applications are first evaluated by case analysts or program assistants. They review the documents and summarize it in the GCMS. If they have any concerns with any document or want the immigration officer to carefully look into a specific document, they will flag it as “review required.” It is the content of the note that is important here. If the review required is for a specific document, while the summary of the note says that an applicant has met the eligibility, or “ready to finalize” it simply means that while the applicant has met the eligibility criteria, but the specific document needs a careful examination form the officer before promoting (eligibility pass) by the officer.

However, if there are concerns, there will be a review required for the eligibility, and there will be no text to the effect “ready to finalize” or pass. The note will specifically state job duties do not match, or the employment cannot be verified, or the number of years of work experience claimed cannot be verified. This is where an application can land in muddy waters. But the final decision rests on the immigration officer. He may override the decision of the analyst / assistant or go with the analysis of the analyst / assistant.

Even in cases where the analyst / assistant is of the opinion that the applicant has met the eligibility, and there is no “review required,” the officer can replace it with his own opinion. Though rare, but it does happen. This is why the eligibility is only passed when an officer conclusively marks the eligibility as passed.

Finally, there is “review required” for PoF. This is the most common in many applications. This is because, the financial and banking practices of each country are different. Eg. Fixed deposits are know as Certificate of Deposit (CD) in the US. Similarly, treasury bonds, mutual funds, stocks, and many other investment vehicles are there. If your PoF anything other than a bank deposit, it is more likely that it will be marked as “review required.” Also, IRCC does not go by day to day fluctuations in FOREX. Instead, the Canadian federal government issued a quarterly conversion rate for all FOREX vis-a-via CAD. If your PoF is in a foreign currency, then you may have “review required” for the officer to make a determination.

Just because you have “review required” does not mean that you hit the panic mode. Instead, read the context in which it is there. If there is a concern regarding a document, you can send a replacement document via CSE. The most common reasons for RR are:

1. Work reference letter without job duties
2. Work reference letters missing all the details requested by IRCC
3. If you submitted a letter from a colleague because you were unable to get one from your employer, but did not have a LoE on file, this too will lead to RR.
4. Not sufficient work experience in the primary NOC.
5. Inability to verify your employment as your employer details are missing.

There are just some of the scenarios.

In your case you will have to see your GCMS notes to know why you have RR.

The SS is a game of time and patience.

If 2-3 months have passed since your eligibility passed (by an officer, not an analyst or assistant), then you may be in SS. You will have to wait it out. The only thing that can be of some use is CBSA / CSIS notes.

They merely inform you when the agency started processing your security screening and if they have concluded their involvement.

Also try calling IRCC and send a webform (CSE)

If you answered yes to the statutory questions pertaining to rejection, then yes, it will be marked as RR, but that is just for an officer o be aware of the prior rejections. Nothing more.

1. There are many factors that go into the processing to an application. If your application is being processed at a LVO with too much workload, the delays are common. NDVO, London, Montreal are some of the busiest VOs. What matters more is that your application is progressing, even if its slow.

2. This is a matter of personal choice. If you eligibility has been recommended passed, then if you request another set of GCMS notes, you may see that your eligibility has been marked as passed by an officer, or you may get the notes that are similar to the ones you have since no one worked on your application.

Requesting GCMS notes would not harm, but make sure that you keep at least 3-6 weeks between when you received the last GCMS notes and the new request.

3. If no CRS points were claimed, then there is no need to inform IRCC. If your spouse is not a primary applicant, then her work history is irrelevant, so there is no need to inform.

1. I was referring to your dad's passport, if he does not have one, then stick on to his name as it appears in your passport. In the family details, insert his complete name, including the middle name.

As regards the gift deed, if it is for a movable property (money) it need not be registered. Also, the minimum stamp paper value has to be INR 500. A gift deed is different from an affidavit.

I understand your pain and there is no time frame within which IRCC has to conclude the SS.

You need to understand that as a part of procedural fairness, IRCC has to make a decision within a reasonable time. The courts have not defined reasonable time frame, but it is subject to the facts and circumstances.

The longest wait I have seen is 2.5 years. If you have crossed 1 year, you can consider legal options.

Order CBSA and CSIS notes to understand where you stand in security
